Ki\u015fi kendi istedi\u011fi ile i\u015f akdini feshetmesi durumunda k\u0131dem tazminat\u0131 alabilir mi?<\/p>\n<p><strong>Cevap:<\/strong><\/p>\n<p>\u0130\u015fveren ile bir i\u015f akdine dayanarak \u00e7al\u0131\u015fan i\u015f\u00e7ilerin genel olarak \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131, hak ve sorumluluklar\u0131n\u0131 4857 say\u0131l\u0131 i\u015f kanunu d\u00fczenler.<\/p>\n<p>Bununla birlikte mevzuata ayk\u0131r\u0131 olmamak kayd\u0131yla s\u00f6zle\u015fme normlar\u0131 dikkate al\u0131n\u0131r. 1475 say\u0131l\u0131 \u0130\u015f Kanununun (E\u0130K) k\u0131dem tazminat\u0131n\u0131 d\u00fczenleyen 14. maddesi h\u00fck\u00fcmleri d\u0131\u015f\u0131nda di\u011fer t\u00fcm h\u00fck\u00fcmleri kalkm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla k\u0131dem tazminat\u0131n\u0131n \u00f6denip \u00f6denmemesinde esasen 1475 say\u0131l\u0131 kanunun 14. maddesindeki h\u00fckme g\u00f6re hareket olunacakt\u0131r.<\/p>\n<p>\u0130lk olarak s\u00f6ylenmelidir ki; \u0130\u015f\u00e7i kendi iste\u011fiyle i\u015f akdini sona erdirdi\u011fi zaman\u2026 (Di\u011fer bir ifadeyle) i\u015fyerinden istifa ederek ayr\u0131lan i\u015f\u00e7i ihbar ve k\u0131dem tazminat\u0131na hak kazanamayacakt\u0131r.( Yarg\u0131tay 22. Hukuk Dairesi\u2019nin esas: 2013\/25115, karar: 2014\/35292)<\/p>\n<p>Hatta 4857 say\u0131l\u0131 kanunun 17. maddesinde d\u00fczenlenmi\u015f olan ihbar s\u00fcrelerine g\u00f6re i\u015ften ayr\u0131lmak isteyen i\u015f\u00e7i veya i\u015f\u00e7isinin i\u015fine son vermek isteyen i\u015fveren, i\u015f\u00e7inin k\u0131demine g\u00f6re maddede belirtilen s\u00fcrelere uygun olarak fesih bildiriminde bulunmal\u0131d\u0131r. Aksi takdirde her iki taraf i\u00e7in de ihbar tazminat\u0131na h\u00fckmolunur. Bu sebeple -\u00f6denmesi gereken- k\u0131dem tazminat\u0131 bir yana, ihbar s\u00fcrelerine uymaks\u0131z\u0131n i\u015f akdine son veren i\u015f\u00e7i ya da i\u015fveren ihbar tazminat\u0131 \u00f6demek zorunda kalacakt\u0131r.<\/p>\n<p>Unutulmamas\u0131 gereken \u00f6nemli bir husus: i\u015f\u00e7inin iradesiyle istifas\u0131nda k\u0131dem tazminat\u0131na hak kazanabilmenin \u00f6nemli \u015fart\u0131, en az bir y\u0131ld\u0131r \u00e7al\u0131\u015fm\u0131\u015f olmak ve bu \u015farta sahip iken i\u015ften ili\u015fi\u011finin kesilmesidir.<\/p>\n<p>Yukar\u0131daki kapsam d\u0131\u015f\u0131nda, i\u015f\u00e7i, kendi iste\u011fiyle, hakl\u0131 sebep g\u00f6stererek istifa etti\u011finde k\u0131dem tazminat\u0131na hak kazanabilmektedir. \u0130\u015f\u00e7i i\u00e7in hakl\u0131 sebep say\u0131labilecek bir tak\u0131m sebepler \u015fu \u015fekildedir;<\/p>\n<h2>1- \u0130\u015f\u00e7iye Mobbing (Bask\u0131, Zorlama) uygulanarak, istifaya zorlanmas\u0131<\/h2>\n<p>Kimi zaman bir tak\u0131m menfaat i\u00e7in veya ba\u015fka sebeplerle i\u015f\u00e7i \u00fczerinde bask\u0131 kurularak, zorla istifa dilek\u00e7esi al\u0131nmaktad\u0131r.<\/p>\n<p>K\u0131demin (\u00e7al\u0131\u015f\u0131lan s\u00fcre) artmas\u0131yla i\u015f\u00e7inin tazminat hakk\u0131 da do\u011fal olarak artacakt\u0131r. Dolay\u0131s\u0131yla \u00f6rne\u011fin 10 y\u0131ll\u0131k k\u0131demi olan bir i\u015f\u00e7inin kendi iste\u011fiyle istifa ederek do\u011facak haklar\u0131n\u0131 ortadan kald\u0131rmas\u0131 hayat\u0131n ola\u011fan ak\u0131\u015f\u0131na uygun bir davran\u0131\u015f de\u011fildir. Yarg\u0131tay da istikrar kazanan g\u00f6r\u00fc\u015f\u00fcnde \u201ci\u015fyerinde belirli haklar\u0131n\u0131 kazanm\u0131\u015f i\u015f\u00e7inin kendi iradesiyle haklar\u0131n\u0131 ortadan kald\u0131rmas\u0131n\u0131\u201d hayat\u0131n ola\u011fan ak\u0131\u015f\u0131na uygun bulmamaktad\u0131r.<\/p>\n<p>Dolay\u0131s\u0131yla, i\u015f\u00e7iden bask\u0131 yap\u0131larak zorla istifa dilek\u00e7esi al\u0131nd\u0131\u011f\u0131n\u0131n ispatlanmas\u0131 durumunda k\u0131dem tazminat\u0131na hak kazan\u0131lm\u0131\u015f olacakt\u0131r. Bunun gibi, i\u015f\u00e7inin herhangi bir bo\u015f k\u00e2\u011f\u0131ttaki imzas\u0131n\u0131n \u00fczeri doldurularak istifa dilek\u00e7esi \u015feklinde g\u00f6sterilmesi durumunda da i\u015f\u00e7inin, bu k\u00e2\u011f\u0131d\u0131 \u201cistifa etmek amac\u0131yla imzalamad\u0131\u011f\u0131na\u201d ili\u015fkin durumu ispat etmesi \u015fart\u0131yla, k\u0131dem tazminat\u0131 hakk\u0131 do\u011fmu\u015f olmas\u0131 gerekmektedir. Geni\u015fletilebilecek \u00f6rneklere g\u00f6re, k\u0131saca s\u00f6ylemek gerekirse, i\u015f\u00e7inin istifa iradesini yans\u0131tmayan dilek\u00e7e ve beyanlar\u0131na dayanarak k\u0131dem tazminat\u0131 \u00f6dememek gibi sonu\u00e7lar do\u011furacak iekilde hukuka ayk\u0131r\u0131 muamele yap\u0131lamaz.<\/p>\n<h2>2- Sa\u011fl\u0131ktan kaynaklanan nedenler<\/h2>\n<p>\u0130\u015f yerine ilk defa girerken i\u015f\u00e7inin bu i\u015fe uygun oldu\u011funa dair sa\u011fl\u0131k raporu al\u0131nabilir. 4857 say\u0131l\u0131 kanunun 86. maddesine g\u00f6re \u201cA\u011f\u0131r ve Tehlikeli \u0130\u015fler\u201d de ve ayr\u0131ca ayn\u0131 kanunun 85. Maddesine g\u00f6re \u201ckad\u0131n ve \u00e7ocuk i\u015f\u00e7iler\u201d i\u00e7in bu raporun al\u0131nmas\u0131 zorunludur.<\/p>\n<p>\u0130\u015fe girerken sa\u011fl\u0131k raporu al\u0131narak i\u015f\u00e7inin bu i\u015fe elveri\u015fli oldu\u011fu belirlenmi\u015f olabilir. Ancak i\u015fe devam etti\u011fi s\u00fcre sonras\u0131nda i\u015f\u00e7inin bu i\u015fte \u00e7al\u0131\u015fmas\u0131ndan do\u011fan bir sebeple sa\u011fl\u0131\u011f\u0131 bozulabilir. Bu durumda\u00a0sa\u011fl\u0131k durumunun k\u00f6t\u00fcye gitmesi sebebiyle i\u015f\u00e7i kendi iradesiyle i\u015f s\u00f6zle\u015fmesini sona erdirirse k\u0131dem tazminat\u0131na hak kazanacakt\u0131r. Bu durumun tespiti i\u00e7in do\u011fal olarak t\u0131bbi rapor ve g\u00f6r\u00fc\u015flerin aranmas\u0131 gerekece\u011fi s\u00f6ylenebilir.<\/p>\n<h2>3- Genel Ahlak Kurallar\u0131na ve \u0130yi niyet kural\u0131na Uymayan Haller<\/h2>\n<p>Bu hususta uygulamada en \u00e7ok kar\u015f\u0131la\u015f\u0131lan nedenlerden birisi i\u015fverenin kanuna ve\/veya s\u00f6zle\u015fmeye ayk\u0131r\u0131 olarak i\u015f\u00e7inin \u00fccretinin eksik \u00f6denmesidir. Burada \u00fccretten kas\u0131t geni\u015f anlamda \u00fccret olup, ikramiyeler, bayram\/erzak yard\u0131m\u0131, yakacak yard\u0131m\u0131, fazla s\u00fcrelerle \u00e7al\u0131\u015fmalar (fazla mesai), y\u0131ll\u0131k izin, resmi tatil ve hafta tatili gibi alacaklar\u0131n \u00f6denmemesi durumunda da i\u015f\u00e7inin hakl\u0131 bir nedeni bulunmaktad\u0131r. \u015eu halde, i\u015f\u00e7i, \u00fccretinin bir k\u0131sm\u0131n\u0131n eksik veya hi\u00e7 \u00f6denmemesi durumunda istifa etmesiyle k\u0131dem tazminat\u0131na hak kazan\u0131r.<\/p>\n<p>\u0130\u015fverenin veya i\u015fyerinde ba\u015fka kimselerin i\u015f\u00e7iye kar\u015f\u0131 ahlak d\u0131\u015f\u0131, taciz nitelikli ve haysiyetsiz hareketleri i\u015f\u00e7i a\u00e7\u0131s\u0131ndan 4857 say\u0131l\u0131 kanunun 24. maddesinde d\u00fczenlenmi\u015f hakl\u0131 fesih sebebi olup; i\u015f\u00e7inin bunlar\u0131 sebep g\u00f6stererek istifa etmesi k\u0131dem tazminat\u0131n\u0131n \u00f6denmesini gerektirecektir. A\u00e7\u0131klamak gerekir ki, i\u015f\u00e7inin istifas\u0131n\u0131 hakl\u0131 k\u0131lan bu sebepler kimi zaman i\u015fverenden de\u011fil de i\u015fyerindeki ba\u015fka ki\u015filerden kaynaklanabilir. Bu durumda i\u015fverenin, bunlar\u0131 engellememekten dolay\u0131 sorumlulu\u011fu icab\u0131 k\u0131dem tazminat\u0131 \u00f6demesi gerekecektir.<\/p>\n<p>T\u00fcm bunlara i\u015f\u00e7inin y\u0131ll\u0131k izin hakk\u0131n\u0131n kanuna uygun olarak kulland\u0131r\u0131lmamas\u0131, tatillerde \u00e7al\u0131\u015ft\u0131r\u0131l\u0131p hakk\u0131n\u0131n \u00f6denmemesi, sigorta primlerinin eksik\/ge\u00e7 yat\u0131r\u0131l\u0131yor olmas\u0131 gibi \u00f6rnekler eklenebilir. Burada her somut olay i\u00e7in ayr\u0131 de\u011ferlendirme yap\u0131lmas\u0131 gerekmektedir.<\/p>\n<h2>4- Zorlay\u0131c\u0131 Nedenler<\/h2>\n<p>\u201cZorlay\u0131c\u0131 nedenler\u201d (m\u00fccbir sebepler), 4857 say\u0131l\u0131 kanunun 24. maddesindeki III. f\u0131krada yer alm\u0131\u015ft\u0131r. Zorlay\u0131c\u0131 nedenden kas\u0131t, \u201ci\u015f yerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek sebeplerin\u201d ortaya \u00e7\u0131kmas\u0131d\u0131r. Bu sebeplerden birinin olu\u015fmas\u0131 durumunda i\u015f\u00e7i hakl\u0131 nedenle i\u015f akdini feshedebilecek ve k\u0131dem tazminat\u0131na hak kazanacakt\u0131r.<\/p>\n<p>\u0130\u015f\u00e7inin istifas\u0131nda k\u0131dem tazminat\u0131n\u0131 almaya hak kazanabilmesini m\u00fcmk\u00fcn k\u0131lan hakl\u0131 sebepler kanunda s\u0131n\u0131rl\u0131 say\u0131lm\u0131\u015f nedenler de\u011fildir. Dolay\u0131s\u0131yla yukar\u0131daki \u00f6rnekler her bir somut olaya g\u00f6re geni\u015fletilebilir ya da de\u011fi\u015febilir.<\/p>\n<p>\u0130stifa ederken tazminata hak kazanabilme noktas\u0131nda atlan\u0131lmamas\u0131 gereken en \u00f6nemli unsurlar\u0131n ba\u015f\u0131nda, i\u015f\u00e7inin, istifa dilek\u00e7esinde, hakl\u0131 bir ya da birka\u00e7 nedeni a\u00e7\u0131k\u00e7a yaz\u0131p, yazd\u0131\u011f\u0131 bu gerek\u00e7elerle i\u015ften ayr\u0131lmak istedi\u011fini dile getirmesi gerekti\u011fidir.\u00a0 Hi\u00e7bir sebep ya da k\u0131dem tazminat\u0131 almay\u0131 hakl\u0131 g\u00f6sterecek sebeplerden en az birini a\u00e7\u0131k\u00e7a gerek\u00e7e g\u00f6stermeden, sadece \u201cistifa etti\u011fini\u201d dilek\u00e7esinde belirten bir i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanamayaca\u011f\u0131 ya da hakl\u0131 sebebi ayr\u0131ca dile getirmesi kayd\u0131yla k\u0131dem tazminat\u0131n\u0131 hak edebilece\u011fi a\u00e7\u0131kt\u0131r.\u00a0 Yine s\u00f6ylemek gerekir ki bu hakl\u0131 sebeplerin dilek\u00e7ede dile getirilmesi bile yerine g\u00f6re yetmeyecek, bir uyu\u015fmal\u0131k halinde bu hakl\u0131 sebebin v\u00fccut buldu\u011funun ispat\u0131 gerekebilecektir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Soru \u00d6zeti\/\u0130\u00e7eri\u011fi: \u0130stifa ile k\u0131dem tazminat\u0131na hak kazan\u0131l\u0131r m\u0131?
