Gerek\u00e7eli karar hakk\u0131n\u0131n tan\u0131m\u0131 ve anlam\u0131<\/h3>\n<p>Gerek\u00e7eli karar hakk\u0131, Devleti ki\u015filer hakk\u0131nda tesis edilen karar niteli\u011findeki i\u015flemlerin mutlak suretle gerek\u00e7eli olmakla y\u00fck\u00fcml\u00fc tutucu<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> sonu\u00e7 do\u011furan; ve ger\u00e7ek anlam\u0131n\u0131 da bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn hakk\u0131yla yerine getirilmesinde bulan bir temel hakt\u0131r. Anayasan\u0131n 36. maddesindeki hak arama h\u00fcrriyeti ve\u00a0 Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinin (\u0130HAS\u2019\u0131n) adil yarg\u0131lanma hakk\u0131n\u0131 d\u00fczenleyen 6. maddesi bu hakk\u0131n dayana\u011f\u0131 olarak belirlenebilir. Avrupa \u0130nsan Haklar\u0131 Mahkemesinin (\u0130HAM&#8217;\u0131n) bu konuda bir\u00e7ok emsal karar\u0131 vard\u0131r.<\/p>\n<p>Gerek\u00e7eli karar hakk\u0131, yarg\u0131 kararlar\u0131na \u00f6zg\u00fc bir hak olarak g\u00f6r\u00fcl\u00fcr. Ancak, bu hak geni\u015f anlamda kamu makamlar\u0131n\u0131n i\u015flemlerine kar\u015f\u0131 korunma hakk\u0131n\u0131n garanti edilmesini de i\u00e7erir. Bu hakk\u0131n bir sonucu olarak, kamusal i\u015flemlerin (ya da kararlar\u0131n) sebebe ba\u011flanmas\u0131 gerekir.<\/p>\n<p>\u201cGerek\u00e7e; h\u00fckm\u00fcn dayanaklar\u0131n\u0131n akla, hukuka ve maddi olaya uygun a\u00e7\u0131klamas\u0131d\u0131r.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Gerek\u00e7e, \u00a0\u201ckamu g\u00fcc\u00fcn\u00fcn hukuka uygun kullan\u0131ld\u0131\u011f\u0131n\u0131 hakl\u0131 ve tutarl\u0131 olarak anlat\u0131r ve temellendirir.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> De\u011fi\u015fik anlat\u0131mla gerek\u00e7e i\u015flemi yapan makam\u0131 kanunun s\u00f6z\u00fc ve \u00f6z\u00fcne uygun davranmaya; do\u011fru ve anlaml\u0131 olgular\u0131 bulmaya ve i\u015flemin kayna\u011f\u0131n\u0131 denetlemeye zorlar.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<h4><\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131n\u0131n tan\u0131nmas\u0131yla, \u201cdavan\u0131n taraflar\u0131n\u0131n mahkeme karar\u0131n\u0131n dayana\u011f\u0131n\u0131 \u00f6\u011frenerek mahkemelere ve genel olarak yarg\u0131ya g\u00fcven duymalar\u0131 da sa\u011flanacakt\u0131r.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Bu sebeple gerek\u00e7e, gerek kararlar\u0131n verilmesinden \u00f6nceki s\u00fcre\u00e7lerdeki iddia ve savunmalarda; gerekse de verilen kararlardaki h\u00fck\u00fcmlerin hukuka ayk\u0131r\u0131l\u0131klar\u0131ndan bahisle yap\u0131lacak ba\u015fvurularda, \u00f6nemli bir veri te\u015fkil eder. Anayasa Mahkemesi karar\u0131nda,<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> gerek\u00e7eli karar hakk\u0131n\u0131n, -Anayasa Mahkemesinin kendi deyimiyle,- \u201cki\u015filerin adil bir \u015fekilde yarg\u0131lanmalar\u0131n\u0131 sa\u011flamay\u0131 ve denetlemeyi ama\u00e7lad\u0131\u011f\u0131\u201d belirtilmektedir.<\/p>\n<p>Bu ba\u011flamda, kanun yollar\u0131na ba\u015fvurularda, karar\u0131n yeterli gerek\u00e7eye ba\u011flanamad\u0131\u011f\u0131; gerek\u00e7esiz oldu\u011fu; veya h\u00fckm\u00fcn, gerek\u00e7esi ile ba\u011flant\u0131l\u0131 olmad\u0131\u011f\u0131 gibi hususlar dile getirilebilir.<\/p>\n<h3>2. Kapsam<\/h3>\n<h4>2.1. Gerek\u00e7eli karar hakk\u0131n\u0131n as\u0131l konusu: yarg\u0131sal kararlar<\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131, bu hakk\u0131n i\u00e7erdi\u011fi gerekler bak\u0131m\u0131ndan, yukar\u0131da da denildi\u011fi \u00fczere, yarg\u0131 kararlar\u0131na \u00f6zg\u00fc oldu\u011fu gibi bir bak\u0131\u015f vard\u0131r. Bu do\u011frudur. Hatta, gerek\u00e7eli karar hakk\u0131 i\u00e7in \u00f6nceden varl\u0131\u011f\u0131 gerekli olan \u201chukuki dinlenilme hakk\u0131\u201dn\u0131n da yarg\u0131 makamlar\u0131 \u00f6n\u00fcnde dinlenilme olarak yorumland\u0131\u011f\u0131 g\u00f6r\u00fcl\u00fcr.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> \u00a0Bu a\u00e7\u0131dan as\u0131l ve \u00f6ncelikli olan da, yarg\u0131laman\u0131n duru\u015fmal\u0131 g\u00f6r\u00fclmesi; iddia ve savunmalar\u0131n ya da kar\u015f\u0131 iddialar\u0131n a\u00e7\u0131k duru\u015fmada ileri s\u00fcr\u00fclmesidir.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>Yarg\u0131sal kararlar gerek\u00e7eli olmak zorundad\u0131r. Bu kararlar gerek\u00e7esi yaz\u0131lmadan a\u00e7\u0131klanamaz. Bilhassa Anayasa Mahkemesi kararlar\u0131nda bu kural \u00e7ok \u00f6nemlidir.<\/p>\n<h4><\/h4>\n<p>Gerek\u00e7enin h\u00fckm\u00fc yorumlamada etkili oldu\u011fu d\u00fc\u015f\u00fcncemize en g\u00fczel \u00f6rnek, \u201cgerek\u00e7eleriyle yorumlanan\u201d yorumlu ret kararlar\u0131d\u0131r. Yorumlu ret kararlar\u0131,<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> kanunlar\u0131n iptal taleplerini, i\u00e7erdi\u011fi gerek\u00e7e ve a\u00e7\u0131klama dairesinde Anayasaya uygun olduklar\u0131ndan bahisle reddedilmesini i\u00e7erirler. T\u00fcm Mahkeme kararlar\u0131 gibi Anayasa Mahkemesinin kararlar\u0131 da, nihayetinde \u201cgerek\u00e7eye ba\u011fl\u0131 h\u00fck\u00fcm\u201d niteli\u011findedirler.<\/p>\n<p>Yarg\u0131 kararlar\u0131n\u0131n taraflar\u0131 tatmin etmesi, yeterli gerek\u00e7eye ba\u011flanmas\u0131 ile m\u00fcmk\u00fcn olur. Yarg\u0131 kararlar\u0131n\u0131n gerek\u00e7eyle ba\u011fl\u0131 olmamas\u0131 ve keyfili\u011fe giden yolu a\u00e7abilir;<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> \u00e7\u00fcnk\u00fc, bu kararlar\u0131n hukuki \u00f6l\u00e7\u00fclerde denetlenme imk\u00e2n\u0131n\u0131 ortadan kald\u0131r\u0131r.<\/p>\n<h4>2.1.1. Gerek\u00e7eli karar hakk\u0131n\u0131n do\u011fas\u0131ndan kaynaklanan geni\u015flik<\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131n\u0131n sadece yarg\u0131sal usullerle verilecek kararlar ve bu kararlar\u0131n verilmesi ile ilgili s\u00fcrece \u00f6zg\u00fc anlam ifade etti\u011fi s\u00f6ylenebilir. Bu tez, hukukta kamusal makamlara etkili eri\u015fim hakk\u0131n\u0131n ayr\u0131ca mevcut oldu\u011fu gibi bir iddiayla da desteklenebilir.<\/p>\n<p>Etkili eri\u015fim hakk\u0131, dar anlamda ad\u0131 \u00fczerinde, t\u00fcm kamusal makamlara eri\u015febilmesini; kamusal makamlar\u0131n da bu eri\u015fimlere ve taleplere hakl\u0131 gerek\u00e7elerle cevap verme sorumlulu\u011fu y\u00fckler. Kamusal makamlar\u0131n eri\u015fimlere verdikleri cevaplarda gerek\u00e7e y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc etkili eri\u015fim hakk\u0131 kadar gerek\u00e7eli karar hakk\u0131yla da temellendirilebilir.<\/p>\n<p>Yukar\u0131daki anlat\u0131ma g\u00f6re etkili eri\u015fim hakk\u0131; kamusal makamlara yap\u0131lacak ba\u015fvuruya verilecek cevaplarda bir anlam ifade edecektir. Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda, etkili eri\u015fim hakk\u0131n\u0131n, kamusal makamlar\u0131n, bir ba\u015fvuru ya da talep olmadan, do\u011frudan do\u011fruya yapt\u0131klar\u0131 i\u015flemleri -ki bu i\u015flemler a\u015fa\u011f\u0131da konuya \u00f6zg\u00fc olarak ayr\u0131ca de\u011finilecek olan- yasama, y\u00fcr\u00fctme ve idare i\u015flemleri olabilir;- kapsamayaca\u011f\u0131 s\u00f6ylenebilir. Bu t\u00fcr bir yorumlamadaki \u201chak mahrumiyeti ya da daralmas\u0131\u201dndan kaynaklanacak bo\u015fluk, \u201cgeni\u015f anlamda gerek\u00e7eli karar hakk\u0131\u201dyla doldurulabilir.<\/p>\n<h4><\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131n\u0131n geni\u015f yorumu (geni\u015f anlamda gerek\u00e7eli karar hakk\u0131), iki kapsamda g\u00f6r\u00fclmelidir:<\/p>\n<p>1-) Geni\u015f anlamda gerek\u00e7eli karara hakk\u0131, sadece yarg\u0131sal kararlara m\u00fcnhas\u0131r (=s\u0131n\u0131rl\u0131) kalmaz. Ki\u015filerin ki\u015fisel yararlar\u0131 bak\u0131m\u0131ndan ilgisine g\u00f6re di\u011fer kamusal makamlar\u0131n kararlar\u0131n\u0131 da kapsar.<\/p>\n<p>2-) Geni\u015f anlamda gerek\u00e7eli karar hakk\u0131, bir ba\u015fka a\u00e7\u0131dan da \u00f6nem arzeder:\u00a0 Kamusal makamlar\u0131n topluma hesap verebilirli\u011fi, topluma; eylem ve i\u015flemlerini hukuka uygun usullerle sorgulayabilme hakk\u0131 verir. Toplumun, kamusal makamlar\u0131n eylem ve i\u015flemlerini hukuki usuller dairesinde sorgulayabilme hakk\u0131, demokrasilerde y\u00f6netime kat\u0131lma hakk\u0131n\u0131n bir gere\u011fi ve t\u00fcr\u00fcd\u00fcr. Bu hakk\u0131n etkilili\u011fi, kamu makamlar\u0131n\u0131n herkesi ilgilendiren karar ve i\u015flemlerine etkili olarak <a href=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/yargi-kararlarinin-internette-yayinlanmasi\/\" target=\"_blank\" rel=\"noopener noreferrer\">eri\u015febilmekle sa\u011flanm\u0131\u015f<\/a> olur. Bunun, hakl\u0131 istisnas\u0131, ki\u015fisel verilerin korunmas\u0131nda; ve ayr\u0131ca kamusal karar ve i\u015flemlerin kamu d\u00fczeni ve kamu yarar\u0131 dolay\u0131s\u0131yla gizli tutulmas\u0131nda g\u00f6r\u00fclebilir.<\/p>\n<p><a href=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/yargi-kararlarinin-internette-yayinlanmasi\/\" target=\"_blank\" rel=\"noopener noreferrer\">Gerek\u00e7eleri a\u00e7\u0131klanmam\u0131\u015f eylem ve i\u015flemlere eri\u015fimin<\/a> etkili olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnmek m\u00fcmk\u00fcn de\u011fildir. Gerek\u00e7esi olmayan eylem ve i\u015flem denetlenebilme imk\u00e2n\u0131n\u0131nda uzak kalm\u0131\u015f olur.<\/p>\n<p>Kamu makamlar\u0131n\u0131n karar ve i\u015flemlerinin, davalarda ya da di\u011fer hukuki hak arama s\u00fcre\u00e7lerinde herkesin;<\/p>\n<p>1-) Bunlardan do\u011fan hukuki haklar\u0131n\u0131 ileri s\u00fcrebilmeleri;<\/p>\n<p>2-) E\u015fitlik ilkesine uygunluk i\u00e7in emsal olarak ileri s\u00fcrebilmeleri;<\/p>\n<p>Bunlardan haberdar olmalar\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n<p>Kamusal makamlar\u0131n eylem ve i\u015flemlerinin hukuka uygunluklar\u0131 karinesi;\u00a0 yarg\u0131sal kararlar\u0131n ya da ki\u015fisel veyahut genel d\u00fczenleyici t\u00fcm i\u015flemlerin gerek\u00e7eli olmas\u0131n\u0131 gerektirir. \u00c7\u00fcnk\u00fc bu \u015fekildeki \u201cge\u00e7erlilik karinesi\u201dne<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> sahip i\u015flemler hakk\u0131nda etkili ba\u015fvuru hakk\u0131n\u0131n anlaml\u0131 olmas\u0131; bunlar\u0131n gerek\u00e7esinin \u00f6\u011frenilmesine eri\u015filebilir derecede a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olmas\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n<h4>2.1.2. Geni\u015f anlamda gerek\u00e7eli karar hakk\u0131 bak\u0131m\u0131ndan kamusal i\u015flemlerde gerek\u00e7e<\/h4>\n<h4>2.1.2.1. Kanunlar ve di\u011fer metinler<\/h4>\n<p>Milli egemenli\u011fe dayal\u0131 demokratik <a href=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/1982-anayasasina-gore-kanun-kavrami\/\" target=\"_blank\" rel=\"noopener noreferrer\">hukuk devletlerinde kanun<\/a>; milletin kendisine ili\u015fkin t\u00fcm konularda ilk-el olarak kendisinin temsilcileri arac\u0131l\u0131\u011f\u0131yla verdi\u011fi karard\u0131r. Millet iradesinin ilk-el olmad\u0131\u011f\u0131 hi\u00e7bir karar, kanun olarak g\u00f6r\u00fclemez ve y\u00fcr\u00fctmeye yerine getirme yetki ve g\u00f6revi vermez. Yasama yetkisi TBMM taraf\u0131ndan kullan\u0131l\u0131r ve bir ba\u015fka makam ya da organa devredilemez.<\/p>\n<p>Kanun teklifi T\u00fcrkiye B\u00fcy\u00fck Millet Meclisine (TBMM\u2019ye) gerek\u00e7esiyle sunulur. Tekliflerin TBMM komisyonlar\u0131 ve Genel Kurulunda g\u00f6r\u00fc\u015f\u00fcl\u00fcrken ge\u00e7irdi\u011fi de\u011fi\u015fiklikler ve gerek\u00e7eleri de bir o kadar \u00f6nem ta\u015f\u0131r. \u00c7\u00fcnk\u00fc, t\u00fcm bu safahat ve gerek\u00e7eler kanunun amac\u0131n\u0131 ve anlam\u0131n\u0131 tayin ederken yorumlamada etkin rol oynarlar. Kanunlar i\u00e7in \u00f6ng\u00f6r\u00fclen ve yukar\u0131da an\u0131lan gerek\u00e7elerin TBMM internet sitesinden yay\u0131nlanmas\u0131; kanun teklifleri ve bunlar\u0131 gerek\u00e7elerinden haberdar olmay\u0131 m\u00fcmk\u00fcn k\u0131lmaktad\u0131r.<\/p>\n<p>Etki de\u011feri bak\u0131m\u0131ndan kanuna e\u015fit g\u00f6r\u00fclebilecek olan karar ve kararnamelerin gerek\u00e7eli olmalar\u0131 da; toplumun haberdar olmas\u0131 ve de\u011ferlendirmesi i\u00e7in \u00f6nemlidir. \u00c7\u0131kar\u0131lmalar\u0131, uygulanmalar\u0131 ya da denetimleri ayn\u0131 kamusal makam\u0131n g\u00f6rev ve yetkisi kapsam\u0131na giren konularda yap\u0131lacak d\u00fczenlemelerin; anla\u015f\u0131labilir ve eri\u015filebilir \u015fekilde gerek\u00e7eli olmalar\u0131 daha \u00f6nemli i\u00e7erik arzetmektedir. \u00c7\u00fcnk\u00fc, bu uygulama, demokrasilerde bunlar\u0131n; toplum ya da ilgililer taraf\u0131ndan hukuki kapsamdaki yorumlanabilme, denetlenebilme ve sorgulanabilmelerine elveri\u015fli ortam sa\u011flam\u0131\u015f olmaktad\u0131r.<\/p>\n<h4>2.1.2.2. \u0130dari i\u015flemlerde\/kararlarda gerek\u00e7e<\/h4>\n<h4>(1) \u0130dari i\u015flemin\/karar\u0131n tan\u0131m\u0131<\/h4>\n<p>\u201c\u0130dari i\u015flem\u201dler idarenin hukuk \u00e2leminde de\u011fi\u015fiklik yapan tek tarafl\u0131 irade beyan\u0131 olarak an\u0131l\u0131rlar. Bu \u015fekilde tan\u0131mlanan i\u015flemlere \u201cidari karar\u201dlar da denilebilir.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> \u0130dare ile muhatab\u0131 aras\u0131nda idarenin \u00fcst\u00fcnl\u00fc\u011f\u00fc \u015fart\u0131yla kurulan uyumlu irade beyan\u0131yla te\u015fekk\u00fcl eden idari s\u00f6zle\u015fmelerde, idarenin ortaya koydu\u011fu irade de, bir t\u00fcr idari karar ya da benzeri mahiyet ta\u015f\u0131r.<\/p>\n<p>\u0130darenin bunlar d\u0131\u015f\u0131ndaki di\u011fer i\u015flemleri, \u00f6zel hukuka tabi(; taraflar\u0131n gerek\u00e7eleri ve i\u00e7eriklerden kar\u015f\u0131l\u0131kl\u0131 e\u015fit olarak haberdar olabilecekleri) \u00f6zel hukuk i\u015flemler(i)dir.<\/p>\n<p>\u0130dari kararlar, bireysel ve genel d\u00fczenleyici kararlar olmak \u00fczere ikiye ayr\u0131l\u0131rlar.<\/p>\n<h4>(2) Gerek\u00e7eli karar hakk\u0131 bak\u0131m\u0131ndan idari \u0130\u015flemler\/kararlar<\/h4>\n<p>Kamu g\u00fcc\u00fc ayr\u0131cal\u0131\u011f\u0131na dayal\u0131 idari i\u015flemlerde \u201cgerek\u00e7e\u201dden; i\u015flemin unsuru olan sebepler anla\u015f\u0131l\u0131r.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> \u0130dari i\u015flemlerde gerek\u00e7e, idareyi, i\u015flemin gerekli bir unsuru olarak, i\u015flem yapmaya sevkeden hukuki ve fiili durum, gereklilik ve etkenlerdir.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<p>\u0130dari i\u015flemler mutlaka hukuka uygun sebebe dayan\u0131rlar. Bu i\u015flemler kanunlar\u0131n ya da Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamelerinin uygulanmas\u0131yla ilgilidirler -ve uygulanmas\u0131 usullerini g\u00f6sterirler-. Bunlar\u0131n dayanaklar\u0131 ve tesis edilme sebeplerinin bilinmesi; bunlar\u0131n hukuken sorgulanabilirleri ve denetlenebilirlikleri i\u00e7in \u00f6nemlidir.<\/p>\n<p>\u201cGerek\u00e7e zorunlulu\u011fu, idari i\u015flemlerin (kanuna) uygun olmas\u0131nda kamusal \u00e7\u0131kar\u0131n bulunmas\u0131 ve ilgililerin hak ve \u00f6zg\u00fcrl\u00fck ihl\u00e2llerini en aza indirmesi y\u00f6nlerinden \u00f6nem ta\u015f\u0131r.\u201d<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a><\/p>\n<p>\u0130darenin takdir yetkisi diyebilece\u011fimiz, kanunda idarenin belli bir \u00e7er\u00e7evede serbest b\u0131rak\u0131ld\u0131\u011f\u0131 hallerde yapaca\u011f\u0131 idari i\u015flemler; e\u015fitli\u011fe hukuka uygun olmas\u0131 gerekti\u011fi kadar hakl\u0131 bir sebep ve gerek\u00e7eye dayanmal\u0131d\u0131r.<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a><\/p>\n<h4>(2) Gerek\u00e7eli karar hakk\u0131 ve gerek\u00e7enin idari i\u015flemlerde g\u00f6sterilmesi<\/h4>\n<p>\u0130dareyi belli bir y\u00f6nde i\u015flem yapmas\u0131na sevkeden sebepleri i\u015flem metninde a\u00e7\u0131k\u00e7a g\u00f6stermelidir. \u00c7\u00fcnk\u00fc, fertler, bilhassa idarenin y\u00fck\u00fcml\u00fcl\u00fck getiren i\u015flemlerin, tesis nedenlerini bilme hakk\u0131na sahiptirler.<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a><\/p>\n<p>Uygulamada kabul g\u00f6ren anlay\u0131\u015f ise, idarenin i\u015fleminde sebep g\u00f6stermek zorunda olmad\u0131\u011f\u0131 y\u00f6n\u00fcndedir.<a href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a><\/p>\n<p>Emsal kararlara<a href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a> g\u00f6re, idarenin sebebi i\u015flemde belirtmezse bile; yarg\u0131 \u00f6n\u00fcnde ger\u00e7e\u011fe uygun olarak a\u00e7\u0131klamas\u0131n\u0131n icap eder. \u00d6rne\u011fin, 5326 say\u0131l\u0131 Kabahatler Kanunu, idari para cezas\u0131 tutanaklar\u0131nda delilerin ve sebebin ne oldu\u011funun yer almas\u0131n\u0131 istemektedir.<\/p>\n<p>\u0130dari i\u015flemlerde gerek\u00e7enin (sebebin) g\u00f6sterilmesi ki\u015filerin idare kar\u015f\u0131s\u0131nda korunmalar\u0131n\u0131 ve hukuki g\u00fcveni art\u0131r\u0131r. \u00c7\u00fcnk\u00fc b\u00f6ylece en az\u0131ndan i\u015fleme muhatap olanlar\u0131n ak\u0131llar\u0131nda, idare sonradan bir sebep bulmu\u015f olabilece\u011fi gibi \u015f\u00fcphe kalkm\u0131\u015f; hukuk g\u00fcvenli\u011fi peki\u015fmi\u015f olur.<a href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a> (Bireyleri ilgilendiren) bireysel i\u015flemlerde sebebe\/gerek\u00e7eye dayanmak zorunludur.<\/p>\n<h4><\/h4>\n<p>\u0130dari i\u015flemler, hukuka uyarl\u0131 olsa bile, \u201csebep ikamesi\u201dyle (idari i\u015flemi tesis ederken d\u00fc\u015f\u00fcnmedi\u011fi ve \u00f6ng\u00f6rmedi\u011fi ama) sonradan g\u00f6sterdi\u011fi bir \u201cikame sebeb\u201de dayand\u0131r\u0131lamazlar.<a href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a><\/p>\n<p>\u0130dari i\u015flemin idarece \u00f6ng\u00f6r\u00fclen sebebi hukuka ayk\u0131r\u0131ysa, yarg\u0131 yerlerinin bunu; ikame edecekleri ba\u015fka bir sebeple hukuka uygun bularak iptal etmemeleri hukuka ayk\u0131r\u0131 g\u00f6r\u00fclmektedir.<a href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a> Zira, aksi halde yarg\u0131 idarenin yerine ge\u00e7mi\u015f olur ve bu durum da Anayasam\u0131zdaki kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesine ayk\u0131r\u0131d\u0131r. Kald\u0131 ki sebep ikamesi idari i\u015flemlerde hukuka ayk\u0131r\u0131 sebebin yerine g\u00f6stermelik bir sebebin ge\u00e7irilmesi<a href=\"#_ftn27\" name=\"_ftnref27\">[27]<\/a> olup; bu hal zaten hukuka ayk\u0131r\u0131d\u0131r.<\/p>\n<p>Bir emsal bir karar da gerek\u00e7eli karar hakk\u0131na i\u015flerlik sa\u011flay\u0131c\u0131 \u015fekilde vurguland\u0131\u011f\u0131 \u00fczere; yarg\u0131 yerinin ger\u00e7ek sebebi ara\u015ft\u0131rmas\u0131 gereklidir: Ara\u015ft\u0131rmayla bulunan ger\u00e7ek \u00a0ve mevcut sebebi g\u00fcn \u0131\u015f\u0131\u011f\u0131na \u00e7\u0131karmak, sebep ikamesi de\u011fildir.<a href=\"#_ftn28\" name=\"_ftnref28\">[28]<\/a><\/p>\n<h4>2.2. Ki\u015fi (\u2248\u00f6zne, muhatap) Bak\u0131m\u0131ndan<\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131n\u0131n s\u00fcjeleri, e\u015f deyi\u015fle muhataplar\u0131 ya da \u00f6zneleri; i\u015flem ya da kararlar\u0131n muhataplar\u0131 ve taraflar\u0131d\u0131r. Anayasa Mahkemesi karar\u0131nda<a href=\"#_ftn29\" name=\"_ftnref29\">[29]<\/a> da, gerek\u00e7eli karar hakk\u0131, yarg\u0131n\u0131n taraflar\u0131 a\u00e7\u0131s\u0131ndan bir \u201chak\u201d olarak g\u00f6r\u00fclmektedir. \u0130\u015flemden ya da karardan dolay\u0131 yararlar\u0131nda azalma (veya ba\u015fka \u015fekilde bir de\u011fi\u015fiklik) olanlar da hakk\u0131n \u00f6znesi olarak g\u00f6r\u00fclmelidirler. Zira aksi halde kararlardan dolay\u0131 zarara u\u011frayanlar\u0131n bir k\u0131sm\u0131 i\u00e7in, hukuk g\u00fcvenli\u011fi ihl\u00e2l edilmi\u015f olur.<\/p>\n<p>Anayasa Mahkemesi gibi, t\u00fcm makam ve mercilerle, kamu t\u00fczel ki\u015filerini ve ger\u00e7ek ki\u015fileri ba\u011flayan t\u00fcm karar ve i\u015flemlerden, toplumun haberdar olmalar\u0131 da bu ba\u011flamda d\u00fc\u015f\u00fcn\u00fclmelidir.<\/p>\n<p>Ayr\u0131ca, yarg\u0131sal ve di\u011fer kamusal karar ve i\u015flemlerin kendileri lehine hak do\u011furdu\u011funu iddia eden; ya da bunlar\u0131 emsal olarak kamu makamlar\u0131na ibraz etmesi gerekebilecek ki\u015filerin de, bu ilgi dairesinde taraf olduklar\u0131 s\u00f6ylenebileceklerdir. Bu gibi bir hallerde ilgili ki\u015filer de geni\u015f anlamda gerek\u00e7eli karar hakk\u0131n\u0131n \u00f6znesi olabileceklerdir.<\/p>\n<p>Demokrasilerde yarg\u0131 kararlar\u0131 ya da t\u00fcm kamusal karar ve gerek\u00e7elerinden haberdar olmak, gerek\u00e7eli karar hakk\u0131ndan daha ziyade haber alma ve bilgi edinme haklar\u0131 ile ilgilidir. Dolay\u0131s\u0131yla bu durumda toplumun gerek\u00e7eli karar hakk\u0131nda ziyade haber alma, haberdar olma ve bilgilenme haklar\u0131n\u0131n \u00f6znesi oldu\u011funu kabul etmek gerekir. Her karar\u0131n Millet ad\u0131na verildi\u011fi ve demokrasilerde kamusal makamlar\u0131n hesap verebilirlikleri; topluma bu makam ve mercilerin eylem ve i\u015flemlerini -hukuka uygun \u00e7er\u00e7evede ve demokratik usullerle- sorgulama, yorumlama ve denetleme haklar\u0131 verir. Bu husus, t\u00fcm kamusal makam ve mercileri; hesap verebilirlik bilinciyle hareket etmek i\u00e7in daha duyarl\u0131 davranmaya ve kararlar\u0131n\u0131 ikna edici ve hakl\u0131 gerek\u00e7elere ba\u011flayarak tesis i\u00e7in daha da \u00f6zen g\u00f6stermeye sevkeder.<\/p>\n<h3>3. Gerek\u00e7eli Karar Hakk\u0131yla ilgili Di\u011fer Haklar<\/h3>\n<h4>3.1. Hak Arama \u00d6zg\u00fcrl\u00fc\u011f\u00fc<\/h4>\n<h4>3.1.1. Genel Olarak Anlam\u0131<\/h4>\n<p>Anayasan\u0131n 141. maddesinden do\u011fan ve yarg\u0131sal kararlar i\u00e7in \u00f6ng\u00f6r\u00fclen gerek\u00e7eli karar hakk\u0131n\u0131n dayana\u011f\u0131n\u0131, Anayasan\u0131n 36. maddesindeki hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc oldu\u011funu<a href=\"#_ftn30\" name=\"_ftnref30\">[30]<\/a> kabul etmek gerekir:<\/p>\n<p>\u201cAvrupa \u0130nsan Haklar\u0131 Mahkemesi de; mahkemenin kararlar\u0131n\u0131 gerek\u00e7eli verme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc hakkaniyete uygun yarg\u0131lama ilkesi \u00e7er\u00e7evesinde tan\u0131maktad\u0131r.\u201d<a href=\"#_ftn31\" name=\"_ftnref31\">[31]<\/a><\/p>\n<p>\u201cHak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc, kendisi bir temel hak niteli\u011fi ta\u015f\u0131mas\u0131n\u0131n \u00f6tesinde, di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fcklerden gereken \u015fekilde yararlan\u0131lmas\u0131n\u0131 ve bunlar\u0131n korunmas\u0131n\u0131 sa\u011flayan en etkili g\u00fcvencelerden biridir. Bu ba\u011flamda Anayasa\u2019n\u0131n, b\u00fct\u00fcn mahkemelerin her t\u00fcrl\u00fc kararlar\u0131n\u0131n gerek\u00e7eli olarak yaz\u0131lmas\u0131n\u0131 ifade eden 141. maddesinin de, hak arama h\u00fcrriyetinin kapsam\u0131n\u0131n belirlenmesinde g\u00f6zetilmesi gerekti\u011fi a\u00e7\u0131kt\u0131r.\u201d<a href=\"#_ftn32\" name=\"_ftnref32\">[32]<\/a><\/p>\n<h4>3.1.2. Di\u011fer Haklarla Kapsay\u0131c\u0131 \u0130lgisi<\/h4>\n<p>Bu bak\u0131mdan hukuki dinlenilme hakk\u0131, konumuz a\u00e7\u0131s\u0131ndan etkili eri\u015fim hakk\u0131 ve savunma hakk\u0131 gibi haklar, hak arama h\u00fcrriyeti kapsam\u0131ndad\u0131rlar. Bu haklar gerek\u00e7eli karar hakk\u0131n\u0131n \u00f6nc\u00fcl\u00fc ya da sonucu niteli\u011finde olu\u015flar\u0131 bak\u0131m\u0131ndan bu hakla ilgili g\u00f6r\u00fclebilirler.<\/p>\n<h4>3.12.1 Etkili Eri\u015fim Hakk\u0131<\/h4>\n<p>Etkili eri\u015fim hakk\u0131, kamusal makamlar\u0131na dilek ve isteklerin yap\u0131labilmesini; ve bu dilek ve isteklerin hukuka en uygun \u015fekilde sonuca ula\u015ft\u0131r\u0131lmas\u0131n\u0131 i\u00e7eren g\u00fcvence ve haklard\u0131r. Gerek\u00e7eli karar hakk\u0131, bir i\u015flemin mutlaka hakl\u0131 gerek\u00e7elere ba\u011flanarak a\u00e7\u0131klanmas\u0131n\u0131 gerektirdi\u011fi halde; etkili eri\u015fim hakk\u0131:<\/p>\n<p>1-) \u00a0Bir istek ve dile\u011fin yap\u0131labilece\u011fi etkili usullerin ve muhatap makam ve mercilerin mevcut olmas\u0131n\u0131;<\/p>\n<p>2-) Muhatap makam ve mercilere ba\u015fvurulara kar\u015f\u0131, yeterli gerek\u00e7elere dayanan sonu\u00e7lar\u0131 i\u00e7eren kamusal i\u015flemlerin tesis edilmesini;<\/p>\n<p>3-) Kamusal makamlar\u0131n yapacaklar\u0131 her t\u00fcrl\u00fc y\u00fck\u00fcmlendirici sonu\u00e7 i\u00e7eren i\u015flemlerde, bu i\u015flemlere kar\u015f\u0131; hangi makamlara ne \u015fekilde ve ne kadar s\u00fcre i\u00e7inde ba\u015fvurulmas\u0131n\u0131n belirtilmesini Anayasa, m. 40\/2);<\/p>\n<p>4-) Geni\u015f anlamda ise, herhangi bir ba\u015fvuru \u015fart\u0131na ba\u011fl\u0131 kalmaks\u0131z\u0131n da konuya ili\u015fkin etkili (ve gerek\u00e7eli) i\u015flem yap\u0131lmas\u0131n\u0131 bekleme hakk\u0131n\u0131;<\/p>\n<p>\u0130\u00e7ermektedir.<\/p>\n<p>\u0130HAM, \u201c\u0130HAS&#8217;\u0131n 13. maddesinin, \u0130HAS\u2019a dayand\u0131r\u0131lan &#8216;savunulabilir bir \u015fik\u00e2yetin&#8217; muhtevas\u0131n\u0131 incelemeye ve uygun bir telafi sunmaya yetkili bir ba\u015fvuru yolunu gerekli k\u0131l(d\u0131\u011f\u0131n\u0131)\u201d de\u011ferlendirmi\u015ftir.<a href=\"#_ftn33\" name=\"_ftnref33\">[33]<\/a><\/p>\n<h4><\/h4>\n<p>\u0130HAM \u00f6rne\u011fin su\u00e7lar\u0131n ayd\u0131nlat\u0131lmas\u0131nda bir \u015fikayet olmadan da etkili soru\u015fturma yap\u0131lmay\u0131\u015f\u0131n\u0131 bu hakk\u0131n ihl\u00e2li kapsam\u0131nda g\u00f6rmektedir:<a href=\"#_ftn34\" name=\"_ftnref34\">[34]<\/a> Mahkemeye g\u00f6re etkili bir soru\u015fturma i\u00e7in; hukukun gerektirdi\u011fi t\u00fcm y\u00f6ntemlerin hi\u00e7bir engellemeyle kar\u015f\u0131la\u015fmayacak \u015fekilde etkili bir \u015fekilde uygulanmas\u0131 gerekmektedir. Bu etkililik, hukuken oldu\u011fu gibi pratikte de olmal\u0131 ve daval\u0131 devletin yetkili makamlar\u0131n\u0131n eylemleri veya ihmalleriyle haks\u0131z bir \u015fekilde engellenmemelidir.<a href=\"#_ftn35\" name=\"_ftnref35\">[35]<\/a><\/p>\n<p>Bir yolun etkilili\u011fi i\u00e7in ba\u011f\u0131ms\u0131z yarg\u0131sal usulleri i\u00e7ermesi ya da karar verecek makam\u0131n, hakk\u0131 ihlal edebilecek kamusal makamdan kurumsal olarak yeterli \u00f6l\u00e7\u00fcde ba\u011f\u0131ms\u0131z olmas\u0131 gerekir.<a href=\"#_ftn36\" name=\"_ftnref36\">[36]<\/a><\/p>\n<p>Yarg\u0131 mercilerine ba\u015fvurular i\u00e7in de etkili eri\u015fim hakk\u0131ndan bahsedilir. \u201cBir mahkemenin demokratik standartlara uygunluk seviyesi ve g\u00fcvenilirli\u011fi, mahkemeye eri\u015fimin a\u00e7\u0131kl\u0131\u011f\u0131nda kendini g\u00f6sterir.\u201d<a href=\"#_ftn37\" name=\"_ftnref37\">[37]<\/a> Mahkemeye ba\u015fvuru hakk\u0131n\u0131n ihlali hallerinde ihlal edilenin, mahkemeye etkili eri\u015fim hakk\u0131 oldu\u011fu anlat\u0131labilir.<a href=\"#_ftn38\" name=\"_ftnref38\">[38]<\/a> Anayasa ve kanunlarda aksi \u00f6ng\u00f6r\u00fclmedik\u00e7e belli bir usul veya \u015farta ba\u011fl\u0131 olmaks\u0131z\u0131n kullan\u0131lan dilek\u00e7e hakk\u0131n\u0131n dilek\u00e7e sahibi lehine yorumlanmas\u0131 gerekir.<a href=\"#_ftn39\" name=\"_ftnref39\">[39]<\/a><\/p>\n<h4><\/h4>\n<p>Anayasan\u0131n 40\/2. maddesi gere\u011fince, kamusal makamlar\u0131n, bilhassa y\u00fck\u00fcmlendirici i\u015flemlerinde; bunlara kar\u015f\u0131 hangi makama, nas\u0131l ve ne kadar s\u00fcrede ba\u015fvurulabilece\u011finin belirtilmeleri gerekmektedir. Bu zorunlulu\u011fa uyulmamas\u0131n\u0131n ya da s\u00f6z\u00fc edilen belirtimlerin a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olmamas\u0131n\u0131n ba\u015fvurucular lehine yorumlanmas\u0131 gerekmektedir.<a href=\"#_ftn40\" name=\"_ftnref40\">[40]<\/a><\/p>\n<p>Buna kar\u015f\u0131l\u0131k, \u00f6rne\u011fin s\u00fcre y\u00f6n\u00fcnden belirsizlik gibi bir taraf\u0131n lehine yorumlanan belirsizlikler; di\u011fer taraf i\u00e7in \u201cusuli kazan\u0131lm\u0131\u015f hak\u201dk\u0131n ihl\u00e2linden bahisle e\u015fitli\u011fe ayk\u0131r\u0131 olmazlar. Nitekim bunun aksi olan ve oy\u00e7oklu\u011fu verilen bu karardaki<a href=\"#_ftn41\" name=\"_ftnref41\">[41]<\/a> kar\u015f\u0131oy da karar\u0131n bu y\u00f6n\u00fcn\u00fcn isabetsiz oldu\u011funa vurgu yapm\u0131\u015ft\u0131r.<\/p>\n<h4>3.1.2.2. Hukuki dinlenilme, iddia ve savunma haklar\u0131<\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131 hukuki dinlenilme hakk\u0131 ve mahkemeye etkili eri\u015fim haklar\u0131n\u0131 tan\u0131makla etkinle\u015ftirilebilir. Bu hak ileri s\u00fcr\u00fclen bu iddia ve savunmalar\u0131n hakk\u0131yla de\u011ferlendirmesi yap\u0131lmadan karar verilemeyece\u011fini i\u00e7erir. Bilhassa, h\u00fckme etkili iddia ve savunmalar\u0131n gerek\u00e7ede kar\u015f\u0131lanmamas\u0131 yarg\u0131n\u0131n yasal ve hukuki standartlara uymad\u0131\u011f\u0131n\u0131 g\u00f6sterir veya hukukun adalete hizmet etmemi\u015f olmas\u0131 ihtimalini g\u00fcndeme getirir\/kuvvetlendirir.<a href=\"#_ftn45\" name=\"_ftnref45\">[45]<\/a><\/p>\n<p>Savunma hakk\u0131yla ki\u015filerin kamusal makamlar \u00f6n\u00fcnde kendilerini savunur i\u00e7erikli beyan ve ifade verme i\u015flemi aras\u0131nda fark vard\u0131r. Hukuki dinlenilme hakk\u0131 i\u00e7in bu ifade ve beyanlar\u0131n da dinlenilmesi \u015fartt\u0131r. Bununla birlikte, su\u00e7lanan\u0131n son savunmas\u0131n\u0131n al\u0131nmas\u0131 elzemdir. \u201cSavunma almak\u201dtan maksad\u0131n; (soru\u015fturmada tan\u0131klar\u0131n ve soru\u015fturulan\u0131n ifadelerinin al\u0131nmas\u0131n\u0131n ve), olay\u0131n ve lehe ve aleyhe t\u00fcm delillerin ara\u015ft\u0131r\u0131lmas\u0131ndan sonra, soru\u015fturulan\u0131n (son olarak) savunmas\u0131n\u0131n al\u0131nmas\u0131\u201d<a href=\"#_ftn46\" name=\"_ftnref46\">[46]<\/a> oldu\u011fu s\u00f6ylenmelidir.<\/p>\n<p>Karar gerek\u00e7elerinde iddia ve savunmalar\u0131n kar\u015f\u0131lanmam\u0131\u015f olmas\u0131, hukuki dinlenilme hakk\u0131 ba\u011flam\u0131nda gerek\u00e7eli karar hakk\u0131n\u0131n ihl\u00e2lidir. \u201cMahkemelerin \u2026iddia ve savunmalara \u015feklen cevap vermi\u015f olmalar\u0131 yeterli olmay\u0131p; (bunlara) verilen cevaplar\u0131n dayanaks\u0131z olmamas\u0131, mant\u0131kl\u0131 ve tutarl\u0131 olmas\u0131 da gerekir.\u201d <a href=\"#_ftn47\" name=\"_ftnref47\">[47]<\/a><\/p>\n<p>Sonu\u00e7ta hukuki dinlenilme hakk\u0131 adil bir karar\u0131n \u00e7\u0131kar\u0131larak muhatab\u0131na tebli\u011fini zorunlu k\u0131lar; ve mahkeme kararlar\u0131n\u0131n gerek\u00e7elerine, iddia ve savunmalarda ileri s\u00fcr\u00fclen hususlar\u0131n yans\u0131t\u0131lmas\u0131n\u0131 da gerektirir.<a href=\"#_ftn48\" name=\"_ftnref48\">[48]<\/a> G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, hukuki dinlenilme hakk\u0131 gerek\u00e7eli karar ve kanuna eri\u015fim oldu\u011fu kadar mahkemeye e\u015fim hakk\u0131yla da ba\u011flant\u0131l\u0131d\u0131r. Nitekim Alman hukukunda mahkeme kararlar\u0131n\u0131n gerek\u00e7eli olaca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm olmasa da; gerek\u00e7eli karar zorunlulu\u011fu, Anayasada d\u00fczenlenen hukuki dinlenilme hakk\u0131n\u0131n zorunlu bir boyutu olarak g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<h4>4. Gerek\u00e7eli karar hakk\u0131na uyarl\u0131 gerek\u00e7enin niteli\u011fi ve kapsam\u0131<\/h4>\n<h4>4.1. Yeterli gerek\u00e7e \u015fart\u0131<\/h4>\n<p>Hi\u00e7bir gerek\u00e7esi olmayan ya da sebebe dayanmayan yarg\u0131sal ya da di\u011fer kamusal kararlar\u0131n hukuka uygunluklar\u0131ndan bahsedilemez. Yeterli olmayan gerek\u00e7eyle var\u0131lan sonu\u00e7 ya da kurulan h\u00fck\u00fcm de karar\u0131 hukuka ayk\u0131r\u0131 hale getirir. Kald\u0131 ki; Gerek\u00e7esi bilinmeyen bir karara kar\u015f\u0131 gidilecek kanun yolunun etkin kullan\u0131lmas\u0131 ve incelemenin etkin yap\u0131lmas\u0131 beklenemez.<a href=\"#_ftn49\" name=\"_ftnref49\">[49]<\/a><\/p>\n<p>\u201cGerek\u00e7enin \u00f6\u011frenilememesi, gerek\u00e7ede taraflar\u0131n savlar\u0131na cevap verilmemesi ve yetersiz, yasaya dayanmayan gerek\u00e7elerin Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinin 6\/1.maddesine dolay\u0131s\u0131yla adil yarg\u0131lanma hakk\u0131na ayk\u0131r\u0131 oldu\u011funu belirten Hadjinastassiou ( Yunanistan ), Ruiz Torija ( Ispanya ), Georgiadis ( Yunanistan ), De Moor ( Bel\u00e7ika ) kararlar\u0131 bulunmaktad\u0131r.\u201d<a href=\"#_ftn50\" name=\"_ftnref50\">[50]<\/a><\/p>\n<p>\u201cKararlar\u0131n gerek\u00e7eli olmas\u0131, davan\u0131n taraflar\u0131n\u0131n mahkeme karar\u0131n\u0131n dayana\u011f\u0131n\u0131 \u00f6\u011frenerek mahkemelere ve genel olarak yarg\u0131ya g\u00fcven duymalar\u0131n\u0131 sa\u011flad\u0131\u011f\u0131 gibi, taraflar\u0131n kanun yoluna etkili ba\u015fvuru yapmalar\u0131n\u0131 m\u00fcmk\u00fcn hale getiren en \u00f6nemli fakt\u00f6rlerdendir. Gerek\u00e7esi bilinmeyen bir karara kar\u015f\u0131 gidilecek kanun yolunun etkin kullan\u0131lmas\u0131 m\u00fcmk\u00fcn olmayaca\u011f\u0131 gibi; bahsedilen kanun yolunda yap\u0131lacak incelemenin de etkin olmas\u0131 beklenemez.\u201d<a href=\"#_ftn51\" name=\"_ftnref51\">[51]<\/a><\/p>\n<p>Y\u00f6netilenlerin kamusal makamlar\u0131n bir sebebe, bir gerek\u00e7eye dayanmadan yapacaklar\u0131 i\u015flemlere kar\u015f\u0131 korunmalar\u0131 da; geni\u015f anlamda gerek\u00e7eli karar hakk\u0131n\u0131n sa\u011flad\u0131\u011f\u0131 g\u00fcvenceyle m\u00fcmk\u00fcn olur. \u00c7\u00fcnk\u00fc kamusal makamlar, kararlar\u0131n\u0131n mutlak suretle sebebe dayanmas\u0131 gereklili\u011fini; buna uyulmamas\u0131 halinde kanun yollar\u0131yla haklar\u0131n\u0131, etkili eri\u015fim hakk\u0131ndan ziyade; i\u015flemin fiili olarak sebebe dayanmad\u0131\u011f\u0131-ya da sebebin hukuka ayk\u0131r\u0131 oldu\u011fu- noktas\u0131nda; geni\u015f anlamda gerek\u00e7eli karar haklar\u0131n\u0131n ihl\u00e2l edildi\u011fini belirterek arayabilirler.<\/p>\n<h4>4.2. Gerek\u00e7eli karar hakk\u0131n\u0131 sa\u011flayan gerek\u00e7enin nitelikleri<\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131na uyulmu\u015f olmas\u0131 i\u00e7in kamusal i\u015flemlerin gerek\u00e7eli olmalar\u0131 yetmez. Bu gerek\u00e7enin karar\u0131 hakl\u0131 k\u0131lacak t\u00fcm hususlar\u0131 ikna edici seviyede i\u00e7ermesi olmas\u0131 gerekir.<a href=\"#_ftn52\" name=\"_ftnref52\">[52]<\/a><\/p>\n<p>Yarg\u0131 kararlar\u0131nda \u201cgerek\u00e7enin, dosyadaki bilgi ve belgelerin yerinde de\u011ferlendirildi\u011fini g\u00f6sterir bi\u00e7imde; ge\u00e7erli, yasal ve yeterli \u2026bir gerek\u00e7eye dayan\u0131lmadan karar verilmesi; yasa koyucunun amac\u0131na uygun d\u00fc\u015fmez ve uygulamada keyfili\u011fe yol a\u00e7ar.\u201d<a href=\"#_ftn53\" name=\"_ftnref53\">[53]<\/a><\/p>\n<p>Olay\u0131n ne \u015fekilde nas\u0131l meydana geldi\u011fi gibi hususlar kararda irdelenmelidir.<a href=\"#_ftn54\" name=\"_ftnref54\">[54]<\/a> Yeterli gerek\u00e7e, ayn\u0131 zamanda bir birleri ile \u00e7eli\u015fmeyen, tutarl\u0131 i\u00e7erik arzeden gerek\u00e7edir.<a href=\"#_ftn55\" name=\"_ftnref55\">[55]<\/a><\/p>\n<p>\u201cGerek\u00e7e taraflar\u0131n iddialar\u0131n\u0131n tek tek cevaplanmas\u0131n\u0131 zorunlu k\u0131lar.\u201d<a href=\"#_ftn56\" name=\"_ftnref56\">[56]<\/a> Buna kar\u015f\u0131l\u0131k yerle\u015fik i\u00e7tihatlar ve g\u00f6r\u00fc\u015f, kararda h\u00fckme dayanak gerek\u00e7elerin yeterli \u015fekilde g\u00f6sterilmesi halinde, gerek\u00e7ede iddia ve savunmalara cevap verilmesini zorunlu g\u00f6rmemektedir.<a href=\"#_ftn57\" name=\"_ftnref57\">[57]<\/a> Bizce; Mahkeme kararlar\u0131nda, gerek\u00e7e, &#8211; h\u00fckm\u00fc etkileyecek her bir iddia veya savunmay\u0131 da kar\u015f\u0131layacak derecede; yeterli, a\u00e7\u0131k, anla\u015f\u0131l\u0131 ve eri\u015filebilir olmal\u0131d\u0131r. Yarg\u0131sal Kararlar<\/h4>\n<p>Anayasaya g\u00f6re, b\u00fct\u00fcn mahkemelerin her t\u00fcrl\u00fc kararlar\u0131 gerek\u00e7eli olarak yaz\u0131l\u0131r (m. 141) ve bu kararlar t\u00fcm makam ve mercilerle ki\u015fileri ba\u011flar. \u201cKarar\u201d, il\u00e2m\u0131n (=karar metninin) sadece h\u00fck\u00fcm k\u0131sm\u0131ndan ibaret de\u011fildir. \u201cKarar\u201d\u0131n gerek\u00e7e ve h\u00fck\u00fcm k\u0131s\u0131mlar\u0131nda olu\u015ftu\u011fu s\u00f6ylenmi\u015ftir. Tersinden s\u00f6ylemek gerekirse, somut bir karar ve bu karardaki h\u00fck\u00fcm; verilmesini gerektiren somut gerek\u00e7e olmasa verilmez.<\/p>\n<p>Karar\u0131n h\u00fck\u00fcm k\u0131sm\u0131yla gerek\u00e7esi sebep-sonu\u00e7 ili\u015fkisi a\u00e7\u0131s\u0131ndan birbirini tamamlay\u0131c\u0131 olup; gerek\u00e7enin bu \u201ctamamlay\u0131c\u0131l\u0131\u011f\u0131\u201d oran\u0131nda ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 tabi\u00eedir.<a href=\"#_ftn61\" name=\"_ftnref61\">[61]<\/a> Bu ba\u011flay\u0131c\u0131l\u0131k, karar\u0131 kuran unsur olan gerek\u00e7enin ba\u011flad\u0131\u011f\u0131 h\u00fckm\u00fcn ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 \u015feklinde bir ba\u011flay\u0131c\u0131l\u0131kt\u0131r.<\/p>\n<h4><\/h4>\n<p>Anayasa Mahkemesi, bir karar\u0131nda da, \u201cAnayasa Mahkemesinin yerle\u015fik kararlar\u0131nda belirtildi\u011fi gibi, ba\u011flay\u0131c\u0131l\u0131k, kararlar\u0131n sonucu kadar gerek\u00e7eleri y\u00f6n\u00fcnden de ge\u00e7erlidir.\u201d demekle<a href=\"#_ftn62\" name=\"_ftnref62\">[62]<\/a> ayn\u0131 tespiti yapm\u0131\u015ft\u0131r.<a href=\"#_ftn63\" name=\"_ftnref63\">[63]<\/a><\/p>\n<h4><\/h4>\n<p>Genel olarak yarg\u0131 kararlar\u0131n\u0131n gerek\u00e7elerinin h\u00fck\u00fcmle ba\u011flant\u0131l\u0131 bir b\u00fct\u00fcn olmalar\u0131 sebebiyle ve \u00f6l\u00e7\u00fcs\u00fcnde h\u00fck\u00fcmle birlikte ba\u011flay\u0131c\u0131 olmalar\u0131 gerekir. Nitekim:<\/p>\n<p>1-) Gerek\u00e7eli karar hakk\u0131ndan da vazge\u00e7ilemeyi\u015fi;<a href=\"#_ftn64\" name=\"_ftnref64\">[64]<\/a><\/p>\n<p>2-) Gerek\u00e7enin var\u0131lan h\u00fckm\u00fcn birbirlerine kara d\u0131yla an\u0131lan bir b\u00fct\u00fcn olu\u015fturacak \u015fekilde ba\u011fl\u0131 olmalar\u0131;<\/p>\n<p>3-) Gerek\u00e7esi olmayan h\u00fck\u00fcm i\u00e7eren bir karar\u0131n, h\u00fck\u00fcms\u00fcz olu\u015fu;<\/p>\n<p>4-) Anayasa Mahkemesinin kanunu iptal taleplerini, karar gerek\u00e7esindeki a\u00e7\u0131klamalara uygun olarak uygulanmas\u0131 kayd\u0131yla reddetmesi \u015feklindeki \u2013yorumu ret- kararlar\u0131 gibi yarg\u0131sal kararlar;<\/p>\n<p>Bu kararlardaki kurucu unsur olan gerek\u00e7elerin<a href=\"#_ftn65\" name=\"_ftnref65\">[65]<\/a> ba\u011flay\u0131c\u0131 olan h\u00fckm\u00fcn ba\u011fl\u0131l\u0131\u011f\u0131 anlam\u0131nda ba\u011flay\u0131c\u0131 oldu\u011funa i\u015faret eder.<\/p>\n<p>Kararlar veren mahkemeler ve karar\u0131n taraflar\u0131 a\u00e7\u0131s\u0131ndan ise \u015f\u00f6yle bir de\u011ferlendirme yap\u0131labilir:<\/p>\n<p>Yarg\u0131 kararlar\u0131nda gerek\u00e7e, h\u00fckm\u00fc veren mahkemeyi ba\u011flar. H\u00fckm\u00fc veren mahkeme h\u00fck\u00fcmle birlikte dosyadan elini \u00e7eker. Yarg\u0131sal h\u00fck\u00fcmlerin \u00fcst derece mahkemelerinde yarg\u0131sal denetimleri s\u00fcrecinde denetlenen karardaki gerek\u00e7e de\u011fi\u015ftirilemez; daralt\u0131lamaz ve geni\u015fletilemez. \u00dcst derece mahkemeleri h\u00fckm\u00fc denetlerken, i\u00e7erdi\u011fi gerek\u00e7enin hukuka uygun olup olmad\u0131\u011f\u0131na bakar. Gerek\u00e7eye ba\u011fl\u0131 ve gerek\u00e7eyle b\u00fct\u00fcn olu\u015fturan h\u00fckm\u00fcn;\u00a0 \u00fcst derece mahkemelerince kald\u0131r\u0131lmad\u0131k\u00e7a ya da bozulmad\u0131k\u00e7a h\u00fck\u00fcm ve ba\u011fl\u0131 oldu\u011fu gerek\u00e7enin ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 devam eder.<\/p>\n<p>Dolay\u0131s\u0131yla, yasal usul ve \u015fartlar elvermedik\u00e7e, i\u00e7erdi\u011fi gerek\u00e7eye dayanan bir yarg\u0131sal karar\u0131n ba\u011flay\u0131c\u0131l\u0131\u011f\u0131ndan hi\u00e7bir gerek\u00e7eyle ka\u00e7\u0131lamaz. Kamu makam\u0131 ve mercii de b\u00f6yle bir karar\u0131 uygulamaktan hi\u00e7bir gerek\u00e7eyle ka\u00e7\u0131namaz.<\/p>\n<h4><\/h4>\n<p>Mahkeme kararlar\u0131n\u0131n gerek\u00e7eli olmas\u0131n\u0131n mahkemeleri yerindelik denetimi yapar hale getirmeyece\u011fi gibi, h\u00fckme muhatap ki\u015filerin hareket kabiliyetlerini de azaltmaz.<a href=\"#_ftn66\" name=\"_ftnref66\">[66]<\/a> \u00c7\u00fcnk\u00fc, gerek\u00e7eler ki\u015fileri de\u011fil h\u00fckm\u00fc ba\u011flayaca\u011f\u0131ndan; yerindelik denetimine kap\u0131 a\u00e7\u0131lmaz. Ayr\u0131ca mahkeme kararlar\u0131 gerek\u00e7eleri, vard\u0131\u011f\u0131 h\u00fckme dayanak olup, h\u00fck\u00fcm a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olduktan sonra, uygulama kapsam\u0131n\u0131 daraltmayaca\u011f\u0131 da geni\u015fletmeyece\u011fi de malumdur. Kald\u0131 ki yarg\u0131lama usul\u00fcnde h\u00fck\u00fcmde tam bir a\u00e7\u0131kl\u0131\u011f\u0131n olmamas\u0131 halinde; karar\u0131 veren mahkemeden, a\u00e7\u0131klama ve yanl\u0131\u015flar\u0131n giderilmesini istemek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<h4>5.1.2. Di\u011fer kamusal i\u015flem ve kararlarda gerek\u00e7enin ba\u011flay\u0131c\u0131l\u0131\u011f\u0131<\/h4>\n<p>Bir kamu hukuku i\u015flemi de sebepsiz ya da yasal sebebe ayk\u0131r\u0131 olarak yap\u0131lamaz. Yukar\u0131da s\u00f6ylendi\u011fi \u015fekilde ifade etmek gerekirse bir kamusal (\u00f6rne\u011fin idari) i\u015flem ya da kararda istenen sonu\u00e7 (yani konu) \u00f6ng\u00f6r\u00fclen sebebe binaen te\u015fekk\u00fcl etmi\u015ftir. Dolay\u0131s\u0131yla sonu\u00e7 sebeple b\u00fct\u00fcnle\u015fmi\u015ftir. Somut bir sebep olmasayd\u0131, kamusal i\u015flem sonucu olmazd\u0131.<\/p>\n<p>Bu \u015fekilde bir i\u015flem taraflar\u0131 ba\u011flay\u0131c\u0131 olup, bu i\u015flemlerden hukuki hak ve menfaati ihlal olanlar, bu i\u015flemin kald\u0131r\u0131lmas\u0131n\u0131 usul\u00fcne g\u00f6re tesis eden makamdan veya yarg\u0131 mercilerinden isteyebilirler.<\/p>\n<p>\u0130dari i\u015flemlerde gerek\u00e7e, i\u015flemi ispat ve muhatab\u0131 ya da toplum ikna bak\u0131m\u0131ndan<a href=\"#_ftn67\" name=\"_ftnref67\">[67]<\/a> ve daha da \u00f6nemlisi i\u015flemi kuran unsurlardan birisi olarak, i\u015flemle birlikte ba\u011flay\u0131c\u0131d\u0131r. \u0130dari makamlar i\u015flemlerini, i\u00e7erdikleri gerek\u00e7eleri yetersiz ya da farkl\u0131 gerek\u00e7elerle hukuka ayk\u0131r\u0131 bulduklar\u0131nda, kald\u0131rabilirler. Yarg\u0131 merciince sebep unsuru bak\u0131m\u0131ndan iptal edilen i\u015flemleri, mahkeme karar\u0131nda yer almayan ve hukuka uygun di\u011fer bir sebeple tesis edebilirler. Bu gerek\u00e7eler, ancak h\u00fck\u00fcmlerin anlam\u0131n\u0131 bulmak i\u00e7in yap\u0131lacak yorumlamada yararlan\u0131labilecek nitelik arz edebilirler; ayr\u0131ca demokrasilerde toplumun haberdar alma haklar\u0131 gere\u011fince, \u201cbilgilendirici\u201d mahiyette g\u00f6r\u00fclebilirler.<\/p>\n<h4>5.2. Gerek\u00e7eli karara ayk\u0131r\u0131l\u0131\u011f\u0131n yapt\u0131r\u0131m\u0131<\/h4>\n<p>Mahkeme kararlar\u0131n\u0131n ba\u011flay\u0131c\u0131l\u0131\u011f\u0131, -yukardada da s\u00f6ylendi\u011fi gibi- kararlar\u0131n hi\u00e7bir sebep \u00fcretmeksizin uygulanmalar\u0131n\u0131 gerektirir. Bu da \u00f6ncelikle kararlar\u0131n gereklerinin duyarl\u0131l\u0131kla yerine getirilmesi \u015feklinde olur. Uygulanmas\u0131 kesinle\u015fmelerine ba\u011fl\u0131 tutulan yarg\u0131 kararlar\u0131n\u0131n uygulanmas\u0131 i\u00e7in kesinle\u015fmesi beklenir.<\/p>\n<p>Hukukumuzda yarg\u0131 kararlar\u0131n\u0131n ba\u011flay\u0131c\u0131l\u0131\u011f\u0131, uygulanmas\u0131n\u0131 sa\u011flay\u0131c\u0131 hukuksal yollara ba\u015fvurabilme ve bu yollar\u0131 harekete ge\u00e7irebilme hakk\u0131n\u0131 da vermi\u015f olur. Ki\u015filerin kararlar\u0131 uygulamayan makam ve merciler aleyhine yarg\u0131 yoluna ba\u015fvurabilme<a href=\"#_ftn68\" name=\"_ftnref68\">[68]<\/a> haklar\u0131 buna \u00f6rnektir. Kararlar\u0131n gerek\u00e7eli olmalar\u0131, hukuksal denetlenebilirlikleri i\u00e7in zorunludur.<\/p>\n<p>Kararlar\u0131n gerek\u00e7eli olmalar\u0131, savunma ve iddialar\u0131n tam manas\u0131yla ve \u00f6zg\u00fcrce ifade edilmesine imk\u00e2n verilerek dinlenilmesini gerektirir.\u00a0 Hukuki dinlenilme hakk\u0131, bunlara riayet edilmedi\u011fi oranda ihl\u00e2l edilmi\u015f olur.<\/p>\n<p>T\u00fcm bunlar mahkemeye etkili eri\u015fim hakk\u0131yla sa\u011flanabilir. Etkili eri\u015fim hakk\u0131, bir konuda verilecek karar\u0131n, \u00f6nceden bir eri\u015fime ba\u011fl\u0131 olmas\u0131 \u015fekilde anla\u015f\u0131labildi\u011fi gibi; geni\u015f anlamda b\u00f6yle bir ba\u015fvuruya ya da eri\u015fime ba\u011fl\u0131 olmadan verilecek yarg\u0131sal kararlar i\u00e7in de h\u00fck\u00fcm ifade eder.<\/p>\n<h4><\/h4>\n<p>Gerek\u00e7eli karar hakk\u0131n\u0131n yarg\u0131sal kararlara m\u00fcnhas\u0131r yo\u011funlu\u011fu; onun di\u011fer kamusal makamlar\u0131n d\u00fczenleyici veya bireysel i\u015flemlerinde g\u00f6zetilmeyece\u011fi anlam\u0131na gelmemelidir. Gerek\u00e7eli karar hakk\u0131, geni\u015f anlamda t\u00fcm kamusal makam ve mercilerin i\u015flemlerinin gerek\u00e7e ile a\u00e7\u0131klanmas\u0131n\u0131 \u00f6ng\u00f6rmelidir. Etkili eri\u015fim hakk\u0131n\u0131n kamusal makamlara \u00f6nceden yap\u0131lacak taleplerin mevcut olmas\u0131 ile s\u0131n\u0131rl\u0131 \u015fekilde anla\u015f\u0131lmas\u0131 halinde; bu i\u015flem ve kararlar\u0131n gerek\u00e7eli olmas\u0131n\u0131n zorunlu, geni\u015f anlamda gerek\u00e7eli karar hakk\u0131 ile sa\u011flanm\u0131\u015f olur.<\/p>\n<p>Kamusal i\u015flemlerin bir sebep dayanmas\u0131 gerekir. Yerle\u015fik anlay\u0131\u015fa g\u00f6re i\u015flemde sebebin belirtilmesi zorunlu g\u00f6r\u00fclmese de, i\u015flem bir sebebe dayanmal\u0131d\u0131r. \u0130\u015flemden sebebin belirtilmemesi, sonradan farkl\u0131 bir sebep ikame esilmi\u015f olabilece\u011fi \u015f\u00fcphesini bertaraf edemeyecekse; sebebin i\u015flemde a\u00e7\u0131k\u00e7a belirtilmesi hukuk g\u00fcvenli\u011fi ilkesinin ve g\u00fcvencesinin bir gere\u011fidir.<\/p>\n<p>Kanun teklifleri gerek\u00e7eli yay\u0131nlanmakta ve bu tekliflerin TBMM komisyonlar\u0131 ve Genel Kurul\u2019unda g\u00f6r\u00fc\u015f\u00fclmesi tutanaklar\u0131na da eri\u015filebilmektedir. Bir konuda karar alma, uygulama veya uygulamay\u0131 denetleme g\u00f6rev ve yetkilerinin ayn\u0131 makamda birle\u015fti\u011fi hallerde, yap\u0131lacak i\u015flem ya da al\u0131nacak kararlar\u0131n gerek\u00e7eli olmal\u0131d\u0131r. Bu usul hukuk g\u00fcvenli\u011fini peki\u015ftiren bir usuld\u00fcr.<\/p>\n<h4><\/h4>\n<p>Yarg\u0131 kararlar\u0131n\u0131n gerek\u00e7elerinin h\u00fck\u00fcmle ba\u011flant\u0131l\u0131 bir b\u00fct\u00fcn olmalar\u0131 sebebiyle ve \u00f6l\u00e7\u00fcs\u00fcnde h\u00fck\u00fcmle birlikte ba\u011flay\u0131c\u0131 olmalar\u0131 gerekir. Anayasa Mahkemesi kararlar\u0131nda yasamaya m\u00fcdahale niteli\u011fi ta\u015f\u0131mayacak \u015fekilde h\u00fck\u00fcm kurar. Kararda h\u00fckme etkili olan ama h\u00fck\u00fcm niteli\u011finde yaz\u0131lamayacak hususlar ancak gerek\u00e7ede yer alabilirler.
