Tutuklama tedbirinin, gereksiz oldu\u011funa kanaat getirilmesi halinde Cumhuriyet savc\u0131s\u0131nca, h\u00e2kimden tahliye talebi yapmaya gerek  olmaks\u0131z\u0131n kald\u0131r\u0131labilmesi yasal olarak m\u00fcmk\u00fcnd\u00fcr. Tutuklama tedbiri, Cumhuriyet savc\u0131s\u0131n\u0131n &#8220;kovu\u015fturmaya yer olmad\u0131\u011f\u0131 karar\u0131&#8221;yla birlikte de kendili\u011finden sona erecektir.<\/em><\/h3>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-center\"><em>A\u015fa\u011f\u0131da tutuklama tedbirinin sona erdirilmesi; bu karar\u0131 vermeye yetkili Cumhuriyet savc\u0131s\u0131n\u0131n ki\u015fi ve yer y\u00f6n\u00fcnde yetki esas\u0131yla belirlenmesi ve bu yetkinin yarg\u0131sal bir denetime tabi tutulup tutulamayaca\u011f\u0131 hususlar\u0131 incelenmektedir. <\/em><\/h4>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-center\"><em>Yaz\u0131, bu kapsamda, Cumhuriyet savc\u0131s\u0131n\u0131n sadece soru\u015fturma safhas\u0131nda kullanabilece\u011fi an\u0131lan yetkisinin, yarg\u0131sal usullerle denetimine ili\u015fkin bir yasal d\u00fczenleme olmay\u0131\u015f\u0131n\u0131n sak\u0131ncalar\u0131 \u00fczerinde durmakta; b\u00f6yle bir denetime ili\u015fkin yasal d\u00fczenlemenin hukuki g\u00fcvenlik ve su\u00e7tan zarar g\u00f6renlere verilecek ba\u015fvuru hakk\u0131 bak\u0131m\u0131ndan da ceza muhakemesinde taraflar i\u00e7in &#8220;sil\u00e2hlar\u0131n e\u015fitli\u011fi&#8221; ilkelerine uygun olaca\u011f\u0131 kanaatine ula\u015fmaktad\u0131r.<\/em><\/h4>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">1. Tutuklama Tedbirinin Deyim Olarak Tan\u0131m\u0131, Kapsam\u0131 ve \u015eartlar\u0131<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">1.1. Tutuklama tedbirinin \u201ctehlike tedbiri\u201d ve \u201ckoruma tedbiri\u201d ile ili\u015fkisi<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin, ad\u0131 \u00fczerinde, bir ceza veya yapt\u0131r\u0131m de\u011fil; bir tedbir, <em>&#8220;tehlike tedbiri teorisi&#8221;<\/em> kapsam\u0131nda bir <em>\u201ckoruma tedbiri\u201d<\/em> oldu\u011fu \u00f6ncelikle belirtilmelidir. Tutuklama, soru\u015fturma veya kovu\u015fturma safhas\u0131nda, yasal hal ve \u015fartlara ba\u011fl\u0131 olarak, h\u00e2kim karar\u0131yla uygulanabilen bir <em>\u201ckoruma tedbiri\u201d<\/em>dir. Tutuklama tedbirinin \u00f6nemli \u00f6zelli\u011fi, 5271 say\u0131l\u0131 Ceza Muhakemesi Kanununun (=CMK\u2019n\u0131n) 100 ve m\u00fcteakip maddelerindeki hal ve \u015fartlara ba\u011fl\u0131 kal\u0131narak ba\u015fvurulabilir<a id=\"_ftnref1\" href=\"#_ftn1\">[1]<\/a> bir tedbir olmas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Koruma tedbiri, <em>\u201ctehlike tedbiri teorisi\u201d<\/em><a id=\"_ftnref2\" href=\"#_ftn2\">[2]<\/a> i\u00e7inde incelenir ve de\u011ferlendirilir; ve soru\u015fturma ve kovu\u015fturman\u0131n ceza muhakemesi ama\u00e7lar\u0131na\u00a0 -ve dolay\u0131s\u0131yla adalete- ula\u015famamak tehlikesinden korunmas\u0131n\u0131 ama\u00e7lar. Buna g\u00f6re koruma tedbirleri, bir ceza veya yapt\u0131r\u0131m de\u011fil; yarg\u0131laman\u0131n, adaletin ve ki\u015fi haklar\u0131n\u0131n korunmas\u0131 i\u00e7in, gerekli ve hatta zorunlu g\u00f6r\u00fclen; kendisine gerek kalmad\u0131\u011f\u0131 g\u00f6r\u00fcl\u00fcnce de kald\u0131r\u0131lacak \u015fekilde ge\u00e7ici ve zorunlu nitelikteki ceza muhakemesi vas\u0131talar\u0131d\u0131rlar.<a id=\"_ftnref3\" href=\"#_ftn3\">[3]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKoruma tedbiri\u201d olarak <em>\u201ctutuklama tedbiri\u201d<\/em>nden maksat da ceza muhekmesinde soru\u015fturma ve kovu\u015fturma safhalar\u0131nda; delillerin karart\u0131lmas\u0131n\u0131n \u00f6nlenmesi, \u015f\u00fcphelinin veya san\u0131\u011f\u0131n ka\u00e7mas\u0131n\u0131 \u00f6nlemek sureti ile yarg\u0131lama ve yarg\u0131lama sonunda verilecek karar\u0131n etkili sonu\u00e7 do\u011furmas\u0131n\u0131 sa\u011flamakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu tedbir, adli nitelikte bir tedbir olup; tutuklanan ki\u015finin ya\u015fama ve yerle\u015fme ve seyahat h\u00fcrriyetleri ba\u015fta olmak \u00fczere h\u00fcrriyetlerini de k\u0131s\u0131tlam\u0131\u015f olur.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.2. Tutuklama tedbirinin uygulanmas\u0131 i\u00e7in yasal usul ve \u015fartlar<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin usul ve \u015fartlar\u0131, tutuklamay\u0131 h\u00e2kimin karar verebilece\u011fi \u015farta ba\u011flamakta ve ayr\u0131ca <a href=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/ticari-davalarda-arabuluculuga-iliskin-belirsizlikler\/#_ftn47\" data-type=\"URL\" data-id=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/ticari-davalarda-arabuluculuga-iliskin-belirsizlikler\/#_ftn47\" target=\"_blank\" rel=\"noreferrer noopener\">-\u00f6zg\u00fcrl\u00fckler as\u0131l olmas\u0131 sebebiyle- <em>\u201cistisna\u201d<\/em> k\u0131lmaktad\u0131r<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hal ve \u015fartlar\u0131n varl\u0131\u011f\u0131 halinde tutuklaman\u0131n devam\u0131na h\u00e2kim taraf\u0131ndan karar verilebilir. Somut olgulara ba\u011fl\u0131<a id=\"_ftnref5\" href=\"#_ftn5\">[5]<\/a> olarak kuvvetli su\u00e7 \u015f\u00fcphesinin mevcudiyeti \u015fart\u0131yla; delillerin karart\u0131lmas\u0131 ya da ka\u00e7ma ihtimalinin olmas\u0131 tutuklama tedbiri i\u00e7in esas sebepleri te\u015fkil eder. Tutuklamaya, ancak bu hallerin ve sebeplerin varl\u0131\u011f\u0131 halinde karar verilebilir.<a id=\"_ftnref6\" href=\"#_ftn6\">[6]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019da (m. 100) liste halinde yaz\u0131l\u0131 su\u00e7larda \u015f\u00fcphelinin ka\u00e7aca\u011f\u0131n\u0131n varsay\u0131labilece\u011fi de h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklaman\u0131n talep edilmesi yetkisi haz\u0131rl\u0131k soru\u015fturmas\u0131nda Cumhuriyet savc\u0131s\u0131na aittir. Bu safhada tutuklamaya sevk edilen ki\u015fi, h\u00e2kim huzurundaki duru\u015fmada kendisini savunur ve bunun i\u00e7in ayr\u0131ca avukat olan bir m\u00fcdafiin yard\u0131m\u0131ndan yararlan\u0131r.<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a> &nbsp;M\u00fcdafi, tutuklamaya sevk edilenin kendisi se\u00e7er ya da Barodan bir m\u00fcdafiinin g\u00f6revlendirilmesini talep ederse,&nbsp; Baro taraf\u0131ndan g\u00f6revlendirilir. Tutuklaman\u0131n uzat\u0131lmas\u0131nda da CMK\u2019n\u0131n 108\/1. maddesi \u00e7er\u00e7evesinde ayn\u0131 usul ge\u00e7erlidir. (CMK., m. 100\/3).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.3. Haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutuklama tedbirinin sona erdirilmesi usul\u00fc<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklulu\u011fun istisna olmas\u0131, gerek kalmad\u0131\u011f\u0131na kanaat getirilmesi halinde derhal kald\u0131r\u0131lmas\u0131n\u0131 gerektirmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutukluluk, sulh ceza h\u00e2kiminin:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1-) Cumhuriyet savc\u0131s\u0131n\u0131n tutukluluk ya da tutuklulu\u011fun uzat\u0131lmas\u0131 talebinin reddi; ya da,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2-) Tutuklunun tahliye talebinin kabul\u00fc;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kararlar\u0131ndan birisini vermesiyle sona erer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 103\/2 maddesi itibar\u0131yla, haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutuklama tedbirinin gereksiz oldu\u011fu kanaatine var\u0131lacak olmas\u0131 halinde, Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan da, sonland\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Kanun h\u00fckm\u00fc, bu \u201csonland\u0131r\u0131lmay\u0131\u201d, \u201cdo\u011frudan serbest b\u0131rakma\u201d olarak anlatmaktad\u0131r. Tutuklama tedbiri, soru\u015fturmada <em>\u201ckovu\u015fturmaya yer olmad\u0131\u011f\u0131\u201d<\/em> y\u00f6n\u00fcnde bir karar verilmesi -ya da mahkumiyet<a id=\"_ftnref8\" href=\"#_ftn8\">[8]<\/a>, beraat veya d\u00fc\u015fme<a id=\"_ftnref9\" href=\"#_ftn9\">[9]<\/a>&#8211; halinde ise kendili\u011finde sona erer.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Ayr\u0131ca, tutuklulu\u011fun:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1-) Amaca (daha hafif) adli kontrol tedbiriyle veya bir tedbir uygulamadan ula\u015f\u0131labilir olmas\u0131;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2-) Tutukluluk \u015fart veya sebebi ya da sebeplerine ili\u015fkin somut olgular\u0131n yoklu\u011fu;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3-) Yasal h\u00fckm\u00fcn yanl\u0131\u015f veya hatal\u0131 uyguland\u0131\u011f\u0131n\u0131n fark edilmesi;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4-) Bunlardan her birisinin varl\u0131\u011f\u0131 i\u00e7in yeterli bir vicdani kanaat olu\u015fturmamas\u0131;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5-) Tutukluluk i\u00e7in yasal \u015fartlar\u0131n de\u011fi\u015fmesi;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hallerinde, sona erdirilmesi zorunlu olur.<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu gibi hallerde tutuklama tedbirinin sona erdirilmeyi\u015fi, ki\u015fi h\u00fcrriyetini ihl\u00e2ldir. Adli kontrol y\u00f6nteminin ihtiyac\u0131 kar\u015f\u0131layabilmesi hallerinde tutuklama tedbirinin uygulanmas\u0131 ve\/veya devam ettirilmesi halinde, ortaya \u00e7\u0131kacak <em>&#8220;orant\u0131s\u0131zl\u0131k&#8221;<\/em> <a id=\"_ftnref11\" href=\"#_ftn11\">[11]<\/a> ki\u015fi h\u00fcrriyetini ihlal sebebi olacakt\u0131r<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Di\u011fer taraftan Cumhuriyet savc\u0131s\u0131n\u0131n tutulama tedbirinin kald\u0131r\u0131lmas\u0131 yetkisi, haz\u0131rl\u0131k soru\u015fturmas\u0131 evresi i\u00e7in ge\u00e7erli oldu\u011fu i\u00e7in;<a id=\"_ftnref12\" href=\"#_ftn12\">[12]<\/a> kovu\u015fturma evresinde ya da h\u00fckmen tutukluluk,<a id=\"_ftnref13\" href=\"#_ftn13\">[13]<\/a> veya 6706 say\u0131l\u0131 kanuna g\u00f6re su\u00e7lular\u0131n iadesi usulleri kapsam\u0131nda tutuklama hallerini kapsamaz. Bundan ba\u015fka, tutuklama tedbirinin kald\u0131r\u0131lmas\u0131, <em>&#8220;g\u00f6zalt\u0131ndan tahliye&#8221;<\/em>den de farkl\u0131d\u0131r. \u00c7\u00fcnk\u00fc <em>&#8220;g\u00f6zalt\u0131nda tahliye&#8221;<\/em> , soru\u015fturma evresinde yakalan\u0131p g\u00f6zalt\u0131na al\u0131nan \u015f\u00fcphelilerin, Cumhuriyet savc\u0131s\u0131n\u0131n tutuklama tedbirinin uygulanmas\u0131n\u0131 talep etmedi\u011fi hallerde do\u011frudan serbest kalmalar\u0131 halidir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1.4. Tutuklama tedbirinin gerek kalmad\u0131\u011f\u0131nda derhal kald\u0131r\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen usuller<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklaman\u0131n a\u011f\u0131r bir tedbir olmas\u0131 sebebiyle yasal h\u00fck\u00fcmler, mak\u00fbl periyodik aral\u0131klarla denetimi mecburi k\u0131lmaktad\u0131r. E\u015fdeyi\u015fle, bu denetimler yasal us\u00fbl ve \u015fartlarla garanti alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<a id=\"_ftnref14\" href=\"#_ftn14\">[14]<\/a> (CMK., m. 105 ve 108). Bu denetimleri yasal us\u00fbllere uygun olarak yapma ve bir karar verme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc adli makamlara (hakimliklere veya mahkemelere) verilmi\u015f; tutuklulara da tutuklama tedbirinin kald\u0131r\u0131lmas\u0131n\u0131 talep edebilme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r.<a id=\"_ftnref15\" href=\"#_ftn15\">[15]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklular\u0131n mak\u00fbl s\u00fcrede yarg\u0131lanmas\u0131na \u00f6zen g\u00f6sterilmesi gerekti\u011fi gibi, ki\u015fi h\u00fcrriyetinin haks\u0131z olarak k\u0131s\u0131tlanmamas\u0131na da ayn\u0131 \u015fekilde \u00f6zen g\u00f6sterilmesi gerekmektedir.<a id=\"_ftnref16\" href=\"#_ftn16\">[16]<\/a> Di\u011fer taraftan, -Anayasan\u0131n 19\/8. maddesinden yap\u0131lacak \u00e7\u0131kar\u0131mla,- tutuklama tedbirinin, buna gerek kalmad\u0131\u011f\u0131na kanaat getirildi\u011finde hemen;<a id=\"_ftnref17\" href=\"#_ftn17\">[17]<\/a> vakit ge\u00e7irmeden son verilmesi de \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131nmas\u0131n\u0131n bir gere\u011fi olacakt\u0131r.<a id=\"_ftnref18\" href=\"#_ftn18\">[18]<\/a> Tutuklama tedbirinin gerektiren sebeplerin ortadan kalkt\u0131\u011f\u0131na a\u015fa\u011f\u0131da de\u011finildi\u011fi \u00fczere <em>\u201cobjektif bir \u015fekilde kanaat getirilmesi\u201d<\/em> halinde tahliye, bir takdir yetkisi de\u011fil, ba\u011fl\u0131 yetkiyle anlat\u0131labilecek bir usul olabilecektir.<a id=\"_ftnref19\" href=\"#_ftn19\">[19]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Haz\u0131rl\u0131k Soru\u015fturmas\u0131nda Tutuklama Tedbirinin Kald\u0131rmas\u0131 Yetkisi<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">2.1. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131nda ki\u015fi bak\u0131m\u0131ndan yetki&nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Yasal h\u00fck\u00fcmlere g\u00f6re Cumhuriyet savc\u0131s\u0131, soru\u015fturma safhas\u0131nda tutuklamaya gerek kalmad\u0131\u011f\u0131n\u0131 g\u00f6rmesi halinde tutuklunun serbest kalmas\u0131na(=tahliyesine) karar verebilecektir.<a href=\"#_ftn20\" id=\"_ftnref20\">[20]<\/a> Zira CMK\u2019n\u0131n 103\/2. maddesine g\u00f6re <em>\u201c<\/em><em>Soru\u015fturma evresinde Cumhuriyet savc\u0131s\u0131[,] adl\u00ee kontrol veya tutuklaman\u0131n art\u0131k gereksiz oldu\u011fu kan\u0131s\u0131na varacak olursa, \u015f\u00fcpheliyi re&#8217;sen serbest b\u0131rak\u0131r.\u201d<\/em> Gerek\u00e7ede de belirtildi\u011fi<a href=\"#_ftn21\" id=\"_ftnref21\">[21]<\/a> \u00fczere, bu hususta ayr\u0131ca bir h\u00e2kim karar\u0131na gerek yoktur. Dolay\u0131s\u0131yla bu i\u015flem Cumhuriyet savc\u0131s\u0131n\u0131n <em>\u201csal\u0131verme\u201d<\/em> \u015feklinde ortaya \u00e7\u0131kan karar\u0131d\u0131r.<a href=\"#_ftn22\" id=\"_ftnref22\">[22]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin sonland\u0131r\u0131lmas\u0131na ili\u015fkin h\u00e2kim karar\u0131 ya da Cumhuriyet savc\u0131s\u0131 i\u015flemi, -CMK\u2019da \u00f6yle dense de,- fikrimce bir <em>\u201cgeri alma\u201d<\/em> de\u011fil;<a id=\"_ftnref23\" href=\"#_ftn23\">[23]<\/a> tutuklama tedbirinin uyguland\u0131\u011f\u0131 anda sonu\u00e7 do\u011furdu\u011fu i\u00e7in, &nbsp;<em>\u201csona erdirilmesi (=kald\u0131rmas\u0131)\u201d<\/em> i\u015flemidir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 103\/2. maddesinde de belirtildi\u011fi \u00fczere, haz\u0131rl\u0131k soru\u015fturmas\u0131n\u0131n sonunda kamu davas\u0131n\u0131n a\u00e7\u0131lmas\u0131n\u0131 gerektirecek yeterlilikte bir \u015f\u00fcpheye<a href=\"#_ftn24\" id=\"_ftnref24\">[24]<\/a> ula\u015f\u0131lamamas\u0131 halinde de tutuklama tedbirinin derhal sona erdirilmesi gerekecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamu davas\u0131 a\u00e7\u0131lmas\u0131n\u0131 gerektirmeyecek Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan kullan\u0131labilecek \u201c<em>b<\/em><em>u yetkinin tutuklaman\u0131n art\u0131k gereksiz oldu\u011fu kan\u0131s\u0131na var\u0131ld\u0131\u011f\u0131 hallerde ve ancak objektif s\u0131n\u0131rlar i\u00e7erisinde kullan\u0131lma<\/em>[s\u0131 gerekmektedir].\u201d<a href=\"#_ftn25\" id=\"_ftnref25\">[25]<\/a> Bu esas fikrimce tutuklama tedbirinin h\u00e2kim taraf\u0131ndan kald\u0131r\u0131lmas\u0131 halinde de nazara al\u0131nmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00d6rne\u011fin ka\u00e7ma \u015f\u00fcphesinin olup olmad\u0131\u011f\u0131na ili\u015fkin objektif bak\u0131\u015fla karar verirken, ka\u00e7may\u0131 te\u015fvik edecek hal ve \u015fartlar, soru\u015fturmaya konu fiilin a\u011f\u0131rl\u0131\u011f\u0131, konunun \u00f6nemi ve su\u00e7a verilebilecek ceza itibar\u0131yla tutuklama tedbirinin orant\u0131s\u0131z olaca\u011f\u0131 gibi sebeplerle<a href=\"#_ftn26\" id=\"_ftnref26\">[26]<\/a> birlikte; -delillerin karart\u0131lmas\u0131 gibi bir ihtimali de\u011ferlendirmek bak\u0131m\u0131ndan da- m\u00fcsned su\u00e7lamaya ili\u015fkin delillerin ele ge\u00e7irilip ge\u00e7irilmedi\u011fi, ele ge\u00e7irilmesi gereken yeni delillerin olup olmad\u0131\u011f\u0131 gibi hususlar nazara al\u0131nmal\u0131d\u0131r.<a href=\"#_ftn27\" id=\"_ftnref27\">[27]<\/a>&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2.2. Tutuklama tedbirinin h\u00e2kim karar\u0131yla sona erdirilmesi<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n a\u00e7\u0131k h\u00fckm\u00fc, haz\u0131rl\u0131k soru\u015fturmas\u0131nda yetkinin \u00e7er\u00e7evesini ve bu yetkiyi kullanacak makam\u0131 belirlemi\u015ftir. Bu sebeple, tutuklulu\u011fun, haz\u0131rl\u0131k soru\u015fturmas\u0131nda <em>&#8220;adli kontrol talep etmeden kald\u0131rabilme&#8221;<\/em> yetkisi Cumhuriyet savc\u0131s\u0131na ait olmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet savc\u0131s\u0131, haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutuklama tedbirinin adli kontrol \u015fart\u0131yla sona erdirilmesi gibi bir kanaate varmas\u0131 halinde, bunu do\u011frudan yapamaz.<a href=\"#_ftn28\" id=\"_ftnref28\">[28]<\/a> (CMK\u2019n\u0131n 103\/1.). &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c7\u00fcnk\u00fc, Cumhuriyet savc\u0131s\u0131n\u0131n CMK\u2019n\u0131n 103\/2. maddesine dayanan yasal yetkisi:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin adli kontrol \u015fart\u0131yla kald\u0131r\u0131lmas\u0131n\u0131; literat\u00fcrdeki deyimle <em>\u201c\u2018adli kontrol\u2019 \u015fart\u0131yla tahliye talebi\u201d<\/em>ni i\u00e7ermemektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maddeye g\u00f6re <em>\u201cCumhuriyet savc\u0131s\u0131, \u015f\u00fcphelinin adl\u00ee kontrol alt\u0131na al\u0131narak serbest b\u0131rak\u0131lmas\u0131n\u0131 sulh ceza h\u00e2kiminden isteyebilir. Hakk\u0131nda tutuklama karar\u0131 verilmi\u015f \u015f\u00fcpheli ve m\u00fcdafii de ayn\u0131 istemde bulunabilirler.\u201d<\/em><a id=\"_ftnref29\" href=\"#_ftn29\">[29]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 103. maddesinin gerek\u00e7esine<a id=\"_ftnref30\" href=\"#_ftn30\">[30]<\/a> g\u00f6re, tutuklama tedbirine adli kontrol \u015fart\u0131yla son verilmesi, CMK\u2019ya g\u00f6re g\u00f6revli ve yetkili <em>&#8220;sulh ceza h\u00e2kimli\u011fi&#8221;<\/em>nden istenebilecektir.<a id=\"_ftnref31\" href=\"#_ftn31\">[31]<\/a> Mal\u00fbm oldu\u011fu \u00fczere, <em><a href=\"https:\/\/www.hukukiyaklasim.com\/makaleler\/ticari-davalarda-arabuluculuga-iliskin-belirsizlikler\/#_ftn23\" target=\"_blank\" rel=\"noreferrer noopener\">\u201c\u00f6zg\u00fcrl\u00fcklerin k\u0131s\u0131tlanmas\u0131na ili\u015fkin her t\u00fcrl\u00fc uygulama\u201d<\/a><\/em> h\u00e2kim karar\u0131yla m\u00fcmk\u00fcn olabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 104\/2. maddesinin yorumu itibar\u0131yla tutuklu vaziyetteki \u015f\u00fcpheli ya da san\u0131\u011f\u0131n talebi \u00fczerine, tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na haz\u0131rl\u0131k soru\u015fturmas\u0131 evresinde sulh ceza h\u00e2kimi, kovu\u015fturmada davaya bakan mahkeme -ya da yasal usullerin imk\u00e2n vermesi halinde hakimlik- karar verir. CMK\u2019n\u0131n 104\/2. maddesinde, -talep hakk\u0131ndaki- karar\u0131n h\u00e2kime b\u0131rak\u0131lmas\u0131n\u0131n sebebi; fikrimce, konuya ba\u011f\u0131ms\u0131z ve tarafs\u0131z bir h\u00e2kimin bakmas\u0131 ve karar vermesinin adil yarg\u0131lanma hakk\u0131 bak\u0131m\u0131ndan daha uygun olaca\u011f\u0131 d\u00fc\u015f\u00fcncesi olsa gerektir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Kald\u0131 ki Cumhuriyet savc\u0131s\u0131n\u0131n an\u0131lan 103\/2. maddeden kaynaklanan sal\u0131verme yetkisini resen kullanmayaca\u011f\u0131 kanaatinin talep sahiplerinde (=\u015f\u00fcpheli ya da san\u0131kta) olu\u015fmas\u0131 sebebiyle, konuyu ba\u011f\u0131ms\u0131z ve tarafs\u0131z h\u00e2kimin takdir ederek karara ba\u011flamas\u0131, ma\u011fdur ve \u015f\u00fcpheli\/san\u0131k taraflar ve adalet i\u00e7in bir g\u00fcvence olacak; bu us\u00fblde, h\u00e2kim ayn\u0131 zamanda adli kontrol \u015fart\u0131yla tahliyeye de h\u00fckmedebilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama ve yasal kay\u0131tlar\u0131n gerekli g\u00f6rd\u00fc\u011f\u00fc hallerde de tutuklama tedbirinin sona erdirilmesi taleplerine, CMK\u2019n\u0131n 103\/1. maddesine g\u00f6re <em>\u201csulh ceza h\u00e2kimi\u201d<\/em> karar verecektir. An\u0131lan 104\/2. maddede ise bu karar\u0131 <em>\u201ch\u00e2kim\u201d<\/em> verir dense de, bundan da haz\u0131rl\u0131k soru\u015fturmas\u0131nda <em>\u201csulh ceza hakimi\u201d<\/em>ni anlamak gerekir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet savc\u0131s\u0131n\u0131n talep yaz\u0131s\u0131na dair karar\u0131 verecek olan <em>\u201csulh ceza h\u00e2kimi\u201d<\/em> de haliyle <em>\u201csulh ceza hakimli\u011fi\u201d<\/em>nde g\u00f6revli h\u00e2kimdir. 5235 say\u0131l\u0131 kanunun 10\/2. maddesine g\u00f6re, <em>\u201c\u0130\u015f durumunun gerekli k\u0131ld\u0131\u011f\u0131 yerlerde birden fazla sulh ceza h\u00e2kimli\u011fi kurulabilir. Bu durumda sulh ceza h\u00e2kimlikleri numaraland\u0131r\u0131l\u0131r.\u201d<\/em> Birden fazla sulh ceza hakimli\u011finin bulundu\u011fu ve say\u0131yla numaraland\u0131r\u0131ld\u0131\u011f\u0131 yerlerde, g\u00f6revi \u00fcstlenecek <em>\u201csulh ceza hakimli\u011fi\u201d<\/em>,<a href=\"#_ftn32\" id=\"_ftnref32\">[32]<\/a> Cumhuriyet savc\u0131s\u0131n\u0131n, <em>\u201ctutuklama tedbirinin adli kontrol \u015fart\u0131yla kald\u0131r\u0131lmas\u0131\u201d<\/em> y\u00f6n\u00fcndeki taleplerinin intikal ettirildi\u011fi hakimlik, esasen n\u00f6bet\u00e7i sulh ceza hakimli\u011fi -ya da bu usul s\u00f6z konusu olmazsa, bu hakimlik\u00e7e tevzien(\u2248da\u011f\u0131t\u0131mla) belirlenmi\u015f- olmal\u0131d\u0131r.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2.3. Tutukla tedbirinin kald\u0131r\u0131lmas\u0131na haz\u0131rl\u0131k soru\u015fturmas\u0131nda CMK\u2019n\u0131n 103\/2. maddesi gere\u011fince karar verecek Cumhuriyet savc\u0131s\u0131<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2.3.1. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131nda yer, konu ve ki\u015fi y\u00f6n\u00fcnden yetki \u00f6l\u00e7\u00fct\u00fc<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklaman\u0131n kald\u0131r\u0131lmas\u0131na karar verecek Cumhuriyet savc\u0131s\u0131, haz\u0131rl\u0131k soru\u015fturmas\u0131n\u0131 y\u00fcr\u00fcten Cumhuriyet savc\u0131s\u0131 olmal\u0131d\u0131r. Daha da \u00f6nemlisi, tutuklama tedbirinin kald\u0131r\u0131lmas\u0131 yetkisini, fikrimce, tutuklama talebini yapan Cumhuriyet savc\u0131s\u0131 kullanmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Haliyle tutuklama talebini de haz\u0131rl\u0131k soru\u015fturmas\u0131n\u0131 y\u00fcr\u00fcten Cumhuriyet savc\u0131s\u0131 yapmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc haz\u0131rl\u0131k soru\u015fturmas\u0131ndaki t\u00fcm bilgi ve belgelere vak\u0131f olmas\u0131 gereken Cumhuriyet savc\u0131s\u0131, durumu daha iyi takdir edebilir. Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131 kuran yasal h\u00fck\u00fcmlerine burada az da olsa temas edilmelidir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2.3.2. Yetkili Cumhuriyet savc\u0131s\u0131n\u0131n 5235 say\u0131l\u0131 Kanun\u2019un h\u00fck\u00fcmleri kapsam\u0131nda belirlenmesi<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">5235 say\u0131l\u0131 Kanuna g\u00f6re, mahkeme kurulu\u015fu olan her il ve il\u00e7ede Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 kurulur (m.16). <em>\u201c<\/em><em>Ba\u011fl\u0131 il\u00e7elerdeki t\u00fcm savc\u0131lar adli ve idari y\u00f6nden [il] Ba\u015fsavc\u0131l\u0131\u011f\u0131na ba\u011fl\u0131d\u0131r.\u201d<\/em><a href=\"#_ftn33\" id=\"_ftnref33\">[33]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131 b\u00fcnyesinde Cumhuriyet ba\u015fsavc\u0131 vekil(ler)i ve Cumhuriyet savc\u0131lar\u0131 bulunur. 5235 say\u0131l\u0131 Kanunun 18\/1-2. maddesine g\u00f6re Cumhuriyet ba\u015fsavc\u0131s\u0131, <em>\u201cba\u015fsavc\u0131l\u0131\u011f\u0131n verimli, uyumlu ve d\u00fczenli bir \u015fekilde \u00e7al\u0131\u015fmas\u0131n\u0131 sa\u011flamak, i\u015f b\u00f6l\u00fcm\u00fcn\u00fc yapmak\u201d<\/em>la g\u00f6revlidirler. Ayn\u0131 Kanunun 20\/1-2. maddesine g\u00f6re de Cumhuriyet savc\u0131lar\u0131 da, <em>\u201cCumhuriyet ba\u015fsavc\u0131s\u0131 taraf\u0131ndan verilen adl\u00ee ve idar\u00ee g\u00f6revleri yerine getirmek\u201d<\/em>le g\u00f6revlendirmi\u015ftir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Bu anlamda Cumhuriyet savc\u0131lar\u0131 ve Cumhuriyet ba\u015fsavc\u0131s\u0131 i\u015flemlerini Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131 temsilen yaparlar.<a id=\"_ftnref34\" href=\"#_ftn34\">[34]<\/a> Cumhuriyet ba\u015fsavc\u0131s\u0131 da Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131 temsil eder. Dolay\u0131s\u0131yla ceza muhakemesinde her bir Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n kendi b\u00fcnyesi i\u00e7inde <em>\u201csavc\u0131l\u0131\u011f\u0131n b\u00f6l\u00fcnmezli\u011fi\u201d<\/em> ilkesi ge\u00e7erlidir.<a id=\"_ftnref35\" href=\"#_ftn35\">[35]<\/a> Bu sebeple, bir Cumhuriyet savc\u0131s\u0131n\u0131n y\u00fcr\u00fctt\u00fc\u011f\u00fc haz\u0131rl\u0131k soru\u015fturmas\u0131 asl\u0131nda bu Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131 ad\u0131na yap\u0131lm\u0131\u015f olur. Cumhuriyet ba\u015fsavc\u0131 vekilleri de bu a\u00e7\u0131dan; <em>\u201cCumhuriyet savc\u0131lar\u0131n\u0131n adl\u00ee ve idar\u00ee g\u00f6revlerine ili\u015fkin i\u015flemlerini inceleyip Cumhuriyet ba\u015fsavc\u0131s\u0131na bilgi vermek\u201d<\/em>le g\u00f6revli ve yetkilidirler<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Su\u00e7lar\u0131n soru\u015fturulmas\u0131n\u0131n ve di\u011fer g\u00f6revlerin en iyi \u015fekilde yerine getirilmesi, Cumhuriyet savc\u0131lar\u0131n\u0131n g\u00f6revleri, n\u00f6betlerini belirleme; soru\u015fturmay\u0131 yeni g\u00f6revlendirilen Cumhuriyet savc\u0131s\u0131n\u0131n devam ettirmesini \u00f6ng\u00f6rmek ve di\u011fer g\u00f6rev da\u011f\u0131l\u0131mlar\u0131 (<em>&#8220;ba\u015fsavc\u0131l\u0131k g\u00f6revlerinin b\u00fct\u00fcnl\u00fc\u011f\u00fc&#8221;<\/em> kapsam\u0131nda olup<a id=\"_ftnref37\" href=\"#_ftn37\">[37]<\/a>), Cumhuriyet ba\u015fsavc\u0131lar\u0131n\u0131n yetkileri d\u00e2hilindedirler.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5235 say\u0131l\u0131 Kanunun 18\/1-3. maddesinde Cumhuriyet ba\u015fsavc\u0131s\u0131, <em>\u201cgerekti\u011finde adl\u00ee g\u00f6reve ili\u015fkin i\u015flemleri yapmak, duru\u015fmalara kat\u0131lmak ve kanun yollar\u0131na ba\u015fvurmak\u201d<\/em>la da yetkilendirilmi\u015ftir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2.3.3. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na esas soru\u015fturmada hiyerar\u015fik denetimin s\u0131n\u0131r\u0131 olabilir mi? Soru\u015fturma yetkisinin \u00f6zerk bir alan\u0131ndan bahsedilebilir mi?<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Adil yarg\u0131lanma hakk\u0131n\u0131n anlaml\u0131 bir g\u00fcvence sa\u011flam\u0131\u015f olmas\u0131 i\u00e7in, haz\u0131rl\u0131k soru\u015fturmas\u0131, m\u00fcmk\u00fcn oldu\u011funca, bunu ba\u015flatan Cumhuriyet savc\u0131s\u0131nca devam ettirilmeli ve tamamlanmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc, -hemen yukar\u0131da de\u011finildi\u011fi gibi- yapmakta oldu\u011fu soru\u015fturmada en iyi bilgi sahibi bu soru\u015fturmay\u0131 yapan Cumhuriyet savc\u0131s\u0131 olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5235 say\u0131l\u0131 kanunun Cumhuriyet savc\u0131lar\u0131n\u0131n g\u00f6rev ve yetkileri ile ilgili 20\/1-1. maddesindeki <em>\u201cgerekti\u011finde adl\u00ee g\u00f6reve ili\u015fkin i\u015flemleri yapmak, duru\u015fmalara kat\u0131lmak ve kanun yollar\u0131na ba\u015fvurmak,\u201d<\/em> ve 20\/1-4 maddesindeki <em>\u201cKanunlarla verilen di\u011fer g\u00f6revleri yapmak\u201d<\/em> ifadeleri, bu \u015fekilde yoruma dayanak da olmaktad\u0131rlar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu h\u00fck\u00fcmler birlikte de\u011ferlendirildi\u011finde Cumhuriyet ba\u015fsavc\u0131s\u0131n\u0131n ba\u015fsavc\u0131l\u0131k b\u00fcnyesinde g\u00f6revli Cumhuriyet savc\u0131lar\u0131n\u0131n i\u015f ve i\u015flemleri \u00fczerindeki hiyerar\u015fik denetim kapsam\u0131nda addedebilece\u011fimiz denetim yetkileri, kanunlara ayk\u0131r\u0131l\u0131klar\u0131 engellemek, d\u00fczeltmek ya da gidermeye;<a id=\"_ftnref38\" href=\"#_ftn38\">[38]<\/a> adil yarg\u0131lanma hak ve ilkelerine uygunlu\u011fu sa\u011flamaya yo\u011funla\u015fm\u0131\u015f olan, bunu ama\u00e7layan ve bununla s\u0131n\u0131rlanm\u0131\u015f yetkiler olarak g\u00f6r\u00fclmeli ve anla\u015f\u0131lmal\u0131d\u0131r. \u00a0B\u00f6ylelikle Cumhuriyet savc\u0131s\u0131n\u0131n \u015f\u00fcpheli ve san\u0131klar\u0131n aleyhinde oldu\u011fu kadar lehine olan t\u00fcm delilleri de toplama ve kamu davas\u0131 a\u00e7\u0131p a\u00e7mama ya da di\u011fer kararlar\u0131 bak\u0131m\u0131ndan, i\u00e7 b\u00fcnyeye kar\u015f\u0131 da bir anlamda -yani kanunlara ve adil yarg\u0131lanma haklar\u0131na uygun davranmak anlam\u0131nda- <em>&#8220;\u00f6zerk&#8221;<\/em> stat\u00fcs\u00fc sa\u011flanm\u0131\u015f olacakt\u0131r. \u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Tutuklama tedbirinin Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan re\u2019sen (=do\u011frudan do\u011fruya) sona erdirilmesi usul\u00fcn\u00fcn de\u011ferlendirilmesi<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">3.1. Tutuklama tedbirinin do\u011frudan do\u011fruya cumhuriyet savc\u0131s\u0131nca kald\u0131r\u0131lmas\u0131 lehine d\u00fc\u015f\u00fcnceler<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Haz\u0131rl\u0131k soru\u015fturmada savc\u0131l\u0131k, tutuklama tedbirinin, ba\u015fvurulma sebepleri ve yeni geli\u015fmeler hakk\u0131nda, -soru\u015fturmaya ara s\u0131ra kararlar\u0131 ile m\u00fcdahil olan- h\u00e2kime nazaran daha iyi bilgi sahibidir. Bu sebeple, Cumhuriyet savc\u0131s\u0131, kovu\u015fturma a\u015famas\u0131ndan evvel tutuklama tedbirinin hala gerekli olup olmad\u0131\u011f\u0131n\u0131 veya bu uygulamadan vazge\u00e7ilip vazge\u00e7ilemeyece\u011fini de\u011ferlendirmek i\u00e7in en iyi konumdad\u0131r.<a href=\"#_ftn39\" id=\"_ftnref39\">[39]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan kald\u0131r\u0131lmas\u0131 \u015feklindeki tahliye, kanun koyucunun tercihini \u00f6zg\u00fcrl\u00fckten yana kulland\u0131\u011f\u0131 i\u00e7in hakl\u0131<a href=\"#_ftn40\" id=\"_ftnref40\">[40]<\/a> ve isabetli g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Anayasan\u0131n 19\/8. maddesinden de tutuklama tedbirinin gereksiz oldu\u011funa kanaat getirilmesi halinde derhal kald\u0131r\u0131lmas\u0131 gerekti\u011fi anla\u015f\u0131lmaktad\u0131r.<a href=\"#_ftn41\" id=\"_ftnref41\">[41]<\/a> &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu y\u00f6ndeki tahliyenin hakl\u0131l\u0131\u011f\u0131, tutuklama karar\u0131n\u0131n daha evvelki s\u00fcreci kapsayan ve ileriye y\u00f6nelik denetlenmesi gereken karar olmas\u0131<a href=\"#_ftn42\" id=\"_ftnref42\">[42]<\/a> gibi gerek\u00e7eye de dayand\u0131r\u0131labilmektedir. Di\u011fer taraftan bu \u015fekildeki bir tahliyenin mahkemenin tutuklama karar\u0131ndan sonraki evreyi ve geli\u015fmeleri kapsad\u0131\u011f\u0131 i\u00e7in, h\u00e2kim karar\u0131na ayk\u0131r\u0131l\u0131k ya da \u00e7eli\u015fkili bir durum da olmayacakt\u0131r.<a href=\"#_ftn43\" id=\"_ftnref43\">[43]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">3.2. Tutuklama tedbirinin h\u00e2kim taraf\u0131ndan kald\u0131r\u0131lmas\u0131n\u0131 gerektiren sebepler<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>3.2.1. <u>CMK\u2019n\u0131n 104\/2 maddesi h\u00fckm\u00fc ve<\/u> <u>tutuklama tedbirinin kald\u0131r\u0131lmas\u0131nda yetki ve usul paralelli\u011fi ilkesinin de\u011feri<\/u><\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Kamu hukukunda, aksi hukuk kural\u0131n\u0131n yorumundan \u00e7\u0131kar\u0131lmad\u0131\u011f\u0131 s\u00fcrece,<a href=\"#_ftn44\" id=\"_ftnref44\">[44]<\/a>&#8211; <em>\u201c<\/em><em>yetki paralelli\u011fi, bir i\u015flemi yapmaya yetkili olan\u0131n, o i\u015flemi kald\u0131rmaya, de\u011fi\u015ftirmeye, d\u00fczeltmeye ya da geri almaya da yetkili olmas\u0131 anlam\u0131na gelmektedir.\u201d<\/em><a href=\"#_ftn45\" id=\"_ftnref45\">[45]<\/a> Usulde paralellik ise bir i\u015flemin tesis edilmesi i\u00e7in \u00f6ng\u00f6r\u00fclen yasal us\u00fbllere, bu i\u015flem de\u011fi\u015ftirilirken ya da kald\u0131r\u0131l\u0131rken de uyulmas\u0131n\u0131 gerektirmektedir. Bu anlamda konuya bak\u0131lacak olursa:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin uygulanmas\u0131na h\u00e2kim karar verdi\u011fine g\u00f6re bunun Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan sonland\u0131r\u0131lmas\u0131 bu ilkeye ayk\u0131r\u0131 olur.<a href=\"#_ftn46\" id=\"_ftnref46\">[46]<\/a> Haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutuklama tedbirinin Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan do\u011frudan sona erdirilmesi; yetki paralelli\u011fi ilkesini ihl\u00e2l etti\u011fi gibi; mahkeme kararlar\u0131n\u0131n i\u015flevsizle\u015ftirilmesi anlam\u0131na da gelmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 104\/2. maddesindeki tutuklama tedbirinin h\u00e2kim karar\u0131yla sonland\u0131r\u0131labilece\u011fine ili\u015fkin h\u00fck\u00fcm, <em>\u201c104. madde san\u0131k ve \u015f\u00fcphelinin sal\u0131verilme taleplerine ili\u015fkindir\u201d<\/em> dense de; 104. maddede ayr\u0131 bir f\u0131kra olarak yaz\u0131lm\u0131\u015f; kendi i\u00e7inde de anlam b\u00fct\u00fcnl\u00fc\u011f\u00fc olan bir h\u00fck\u00fcmd\u00fcr. Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda CMK\u2019n\u0131n tutuklama tedbiri ile ilgili olarak Cumhuriyet savc\u0131s\u0131na tutuklulu\u011fu resen sonland\u0131rma yetkisi veren 103\/2. maddesi, ayn\u0131 Kanunun 104\/2. maddesiyle \u00e7eli\u015fmektedir.<a id=\"_ftnref47\" href=\"#_ftn47\">[47]<\/a> Kanun koyucu 104. maddeyi 103. maddeden sonra g\u00f6r\u00fc\u015fm\u00fc\u015f ve kabul etmi\u015ftir. Bu gerek\u00e7eye de bak\u0131nca, 104\/2. maddenin haz\u0131rl\u0131k soru\u015fturmas\u0131nda tahliye i\u00e7in de h\u00e2kim karar\u0131n\u0131n gerekece\u011fi iddialar\u0131n\u0131n kendi i\u00e7inde hakl\u0131l\u0131k i\u00e7erdi\u011fi s\u00f6ylenebilecektir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>3.2.2. <u>Tutuklama tedbirinin sona erdirecek makam\u0131n kuvvetler ayr\u0131l\u0131\u011f\u0131 a\u00e7\u0131s\u0131nda durumu<\/u><\/strong><strong><\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Ceza muhakemesinde Cumhuriyet savc\u0131s\u0131n\u0131n konumu tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Cumhuriyet savc\u0131s\u0131n\u0131 y\u00fcr\u00fctme i\u00e7inde g\u00f6ren g\u00f6r\u00fc\u015fler,<a href=\"#_ftn48\" id=\"_ftnref48\">[48]<\/a> yarg\u0131 g\u00fcc\u00fc i\u00e7inde g\u00f6ren g\u00f6r\u00fc\u015flere nazaran a\u011f\u0131rl\u0131k ta\u015f\u0131maktad\u0131r. Yarg\u0131 kuvveti taraf\u0131ndan verilen bir karar\u0131n <em>\u201csiyasal bir organ olan Adalet Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 ve y\u00fcr\u00fctmenin bir <\/em>[g\u00f6revlisi]<em>\u201d<\/em><a href=\"#_ftn49\" id=\"_ftnref49\">[49]<\/a> ve yarg\u0131da <em>\u201cirtibat vas\u0131tas\u0131\u201d<\/em> olan (ve kolluk ve yarg\u0131 makamlar\u0131 aras\u0131nda arac\u0131 i\u015flevi g\u00f6ren<a href=\"#_ftn50\" id=\"_ftnref50\">[50]<\/a>) bir makam taraf\u0131ndan kald\u0131r\u0131lmas\u0131, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesine ayk\u0131r\u0131 g\u00f6r\u00fclebilir; ve <em>\u201c<\/em><em>bu <\/em><em>kald\u0131rma karar\u0131na kar\u015f\u0131 <\/em><em>bir kanun yolunun kabul <\/em><em>edilmeyi\u015fi <\/em><em>\u00e7ok <\/em><em>sak\u0131ncal\u0131d\u0131r.\u201d<\/em><a href=\"#_ftn51\" id=\"_ftnref51\">[51]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Halbuki tutuklama karar\u0131 veren tabii, ba\u011f\u0131ms\u0131z ve tarafs\u0131z h\u00e2kimdir. \u00dcstelik bu h\u00e2kim ayn\u0131 zamanda Anayasan\u0131n 37. maddesinde h\u00e2kim \u00f6n\u00fcne \u00e7\u0131kanlara g\u00fcvence olarak d\u00fczenlenen <em>\u201ctabii (=kanuni) h\u00e2kim\u201d<\/em>dir. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na da ayn\u0131 h\u00e2kimin karar vermesi tabii h\u00e2kim yukar\u0131daki sak\u0131ncay\u0131 da gidermi\u015f olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet savc\u0131s\u0131n\u0131n tutuklama tedbirinin kald\u0131r\u0131lmas\u0131 karar\u0131na kar\u015f\u0131 mahkeme ya da sulh ceza hakimliklerine itiraz yolunun \u00f6ng\u00f6r\u00fclmeyi\u015fi,<a href=\"#_ftn52\" id=\"_ftnref52\">[52]<\/a> hukuk g\u00fcveli\u011fi ilkesine ayk\u0131r\u0131 olacakt\u0131r.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>3.2.3. <u>Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131nda kamu yarar\u0131 ve kamu d\u00fczeni \u00f6l\u00e7\u00fctlerinin dengelenmesi bak\u0131m\u0131ndan durum<\/u><\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirine karar verilmesi ya da devam eden tutuklama tedbirinin sona erdirilmesi i\u00e7in; kamu yarar\u0131n\u0131n, birbirlerine z\u0131t iki olgu olan <em>\u201c\u2018ki\u015fi \u00f6zg\u00fcrl\u00fckleri ile kamu d\u00fczeninin sa\u011flanmas\u0131\u2019n\u0131n birlikte g\u00f6zetilmesi ve dengelenmesi\u201d<\/em> gerekir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kanun koyucunun nazar\u0131nda, CMK\u2019n\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc yasal hal ve \u015fartlar\u0131n kalkt\u0131\u011f\u0131 durumlarda tutuklama tedbirinin derhal ve h\u00e2kim taraf\u0131ndan sona erdirilmesi, bu dengeyi sa\u011flam\u0131\u015f; bu dengeyi olumsuz etkilememi\u015f de olmaktad\u0131r. Hakimin konuya ili\u015fkin i\u015flemlerinin hemen olmas\u0131 halinde, tahliyeye karar verilen ki\u015finin \u00f6zg\u00fcrl\u00fc\u011f\u00fcne kavu\u015fmas\u0131nda bir gecikme de s\u00f6z konusu olmayacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dolay\u0131s\u0131yla tutuklama \u015fartlar\u0131n\u0131n kalk\u0131p kalkmad\u0131\u011f\u0131nda da \u00f6zg\u00fcrl\u00fc\u011f\u00fc k\u0131s\u0131tlayan h\u00e2kimin karar vermesi hem \u00f6zg\u00fcrl\u00fckleri hem de kamu d\u00fczenini dengeleyen kamu yarar\u0131n\u0131n tesisinde en b\u00fcy\u00fck g\u00fcvencedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">3.3. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131ndan sonra yarg\u0131sal denetim <\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin, tutuklama hal ve \u015fartlar\u0131n\u0131n kalkt\u0131\u011f\u0131 kanaatine var\u0131lmas\u0131 halinde, Cumhuriyet savc\u0131s\u0131nca derhal kald\u0131r\u0131lmas\u0131 yerine, tutuklaman\u0131n devam edip etmeyece\u011fine ili\u015fkin karar\u0131n h\u00e2kime b\u0131rak\u0131lmas\u0131n\u0131n ki\u015finin \u00f6zg\u00fcrl\u00fc\u011f\u00fcne kavu\u015fmas\u0131n\u0131 gerektirece\u011fi bir y\u00f6nden hakl\u0131 g\u00f6r\u00fclebilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fakat, dikkat edilirse tutuklama tedbirinin CMK\u2019n\u0131n 103\/2. maddesinin ilk c\u00fcmlesine g\u00f6re sona erdirilmesi i\u00e7in Cumhuriyet savc\u0131s\u0131n\u0131n bu tedbire gerek kalmad\u0131\u011f\u0131n\u0131 \u201c<em>somut olgulara objektif bir bak\u0131\u015fla g\u00f6rmesi\u201d <\/em>de\u011fil; bu y\u00f6nde bir<em> \u201ckanaat\u201de <\/em>varmas\u0131 yeterli g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Halbuki Anayasan\u0131n 138\/1. maddesi, yarg\u0131sal usuller i\u00e7inde kanaat getirme yetkisini sadece hakimlere ve mahkemelere vermi\u015f; bu kanaati de <em>\u201cvicdani kanaat\u201d<\/em> niteli\u011finde olmas\u0131n\u0131 \u015fart ko\u015fmu\u015ftur.&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Di\u011fer taraftan, adil yarg\u0131lanma hakk\u0131, \u015f\u00fcpheli veya san\u0131\u011f\u0131n \u00f6zg\u00fcrl\u00fcklerini g\u00fcvenceye ald\u0131\u011f\u0131 kadar, su\u00e7un t\u00fcm boyutlar\u0131yla ve hukuka ayk\u0131r\u0131 olmayan delillerle ayd\u0131nlat\u0131lmas\u0131n\u0131; ve mahk\u00fbmiyet kararlar\u0131n\u0131n etkili icras\u0131n\u0131 da istemektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu zaruretler kar\u015f\u0131s\u0131nda hakim karar\u0131n\u0131 beklemenin \u015fayet \u00f6zg\u00fcrl\u00fc\u011fe kavu\u015fmay\u0131 geciktirece\u011fi iddialar\u0131 ge\u00e7erli g\u00f6r\u00fclecekse; buna \u00e7are olarak, yasal d\u00fczenlemelerle, Cumhuriyet savc\u0131s\u0131n\u0131n sal\u0131verme karar\u0131, uyguland\u0131ktan sonra yarg\u0131sal denetime tabi tutulabilir:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu kapsamda \u015f\u00fcpheli veya san\u0131\u011f\u0131n Cumhuriyet savc\u0131s\u0131n\u0131n icra edilen sal\u0131verme i\u015fleminin sonradan da olsa \u00f6rne\u011fin 24 saat i\u00e7inde h\u00e2kim onay\u0131na sunulmas\u0131 ve h\u00e2kimin de konuya ili\u015fkin olarak en ge\u00e7 24 veya 48 saat i\u00e7inde karar vermesi y\u00f6ntemi kamu d\u00fczeni ve \u00f6zg\u00fcrl\u00fck \u00e7at\u0131\u015fmas\u0131nda kamu yarar\u0131na olacak \u015fekilde bulunacak bir denge olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu form\u00fcl Anayasan\u0131n;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1-) Anayasan\u0131n, ki\u015filerin tutuklama \u015fartlar\u0131 kalkt\u0131\u011f\u0131nda serbest kalmalar\u0131n\u0131 istemelerine ili\u015fkin 19\/8. maddesine ve,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2-) Adil, en az masrafla ve h\u0131zla yarg\u0131lama yapmak ve karar vermek; di\u011fer bir deyi\u015fle davalar\u0131n h\u0131zla sonu\u00e7land\u0131r\u0131lmas\u0131na ili\u015fkin 141. maddesine;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uygun olacak ve ceza muhakemesinin ama\u00e7lar\u0131na ula\u015fmak da b\u00f6ylelikle daha iyi bir \u015fekilde sa\u011flanm\u0131\u015f olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu form\u00fcl\u00fcn, CMK\u2019da, h\u00e2kim karar\u0131 olmadan yap\u0131lan elkoyma i\u015flemleri i\u00e7in de \u00f6ng\u00f6r\u00fclen bir usul oldu\u011fu hat\u0131rlanacak olursa; b\u00f6yle bir y\u00f6ntemin \u00f6zg\u00fcrl\u00fc\u011f\u00fc korudu\u011fu gibi, ceza muhakemesi ama\u00e7lar\u0131na da uygun oldu\u011fu sonucuna var\u0131lacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Haz\u0131rl\u0131k soru\u015fturmas\u0131nda tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na ya da bu y\u00f6ndeki Cumhuriyet savc\u0131s\u0131 talebine itiraz edilebilir mi?<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">4.1. Tutuklama tedbirinin Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan son erdirilmesi i\u015flemine itiraz\u0131n olmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde d\u00fc\u015f\u00fcnceler<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet savc\u0131s\u0131n\u0131n tutuklama tedbirine son vermesini i\u00e7eren serbest b\u0131rakma i\u015flemine (CMK., m. 103\/2) kar\u015f\u0131 itiraz edilebilmesini sa\u011flayan a\u00e7\u0131k bir yasal h\u00fck\u00fcm yoktur. &nbsp;CMK\u2019da ve di\u011fer kanunlarda bu konuda, kanun yoluna ba\u015fvurunun a\u00e7\u0131k bir h\u00fck\u00fcmle yasaklanmad\u0131\u011f\u0131<a href=\"#_ftn53\" id=\"_ftnref53\">[53]<\/a> &nbsp;da m\u00fc\u015fahede edilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00fcrriyetlerin a\u00e7\u0131k\u00e7a s\u0131n\u0131rlanmad\u0131\u011f\u0131 hallerde serbestli\u011fin as\u0131l oldu\u011funun kabul\u00fc, <em>\u201chukuk g\u00fcvenli\u011fi (=hukuki g\u00fcvenlik)\u201d<\/em> ilkesinin ana kaidesidir. Hukuki belirsizlikler ve \u00f6ng\u00f6r\u00fclemezlik hallerinde de ayn\u0131 yorumun yap\u0131lmas\u0131 gerekmektedir.<a href=\"#_ftn54\" id=\"_ftnref54\">[54]<\/a> Bu yorumla, tutuklama tedbirinin Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan sonland\u0131r\u0131lmas\u0131na kar\u015f\u0131 itiraz \u015feklinde bir kanun yolunun mevcudiyeti kabul edilerek, su\u00e7tan zarar g\u00f6ren ya da daha dar anlamda ma\u011fdura itiraz hakk\u0131 vermek Anayasan\u0131n 36. maddesindeki <em>\u201chak arama h\u00fcrriyeti\u201d<\/em>ne de uygun olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklama tedbirinin devam\u0131 hallerinde, bunun kald\u0131r\u0131lmas\u0131n\u0131 (\u015f\u00fcpheli veya san\u0131k taraf\u0131ndan) talep eden ba\u015fvuru ve bunun reddine itiraz, bir anlamda Cumhuriyet savc\u0131s\u0131n\u0131n tutuklama tedbirinin kald\u0131r\u0131lmas\u0131 karar\u0131 vermemesine kar\u015f\u0131 yap\u0131lm\u0131\u015f olmaktad\u0131r.\u00a0 Bu ba\u015fvurular\u0131 h\u00e2kim inceleme ve karar verme yetkisine sahipken, tutuklama tedbirinin kald\u0131r\u0131lmas\u0131 karar\u0131na kar\u015f\u0131 h\u00e2kime bir ba\u015fvuru veya hi\u00e7 olmazsa itiraz yolunun kapat\u0131lm\u0131\u015f olmas\u0131, taraflara tan\u0131na silahlar\u0131n e\u015fitli\u011fi ve kanun \u00f6n\u00fcnde e\u015fitlik ilkelerine ve su\u00e7tan zarar g\u00f6ren a\u00e7\u0131s\u0131ndan <em>&#8220;adil yarg\u0131lanma hakk\u0131&#8221;<\/em>na ayk\u0131r\u0131 olacakt\u0131r.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Anayasan\u0131n 142\/1. maddesi, mahkemelerin kurulu\u015funun i\u015fleyi\u015flerinin ve yetkilerinin kanunla d\u00fczenlenece\u011fini belirtmi\u015ftir. Dikkat edilirse burada Cumhuriyet savc\u0131lar\u0131 ya da Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n i\u015fleyi\u015fi, takip edecekleri usullerin, g\u00f6rev ve yetkilerinin kanunla d\u00fczenlenece\u011fi anlam\u0131nda a\u00e7\u0131k bir &nbsp;belirleme yoktur. Bu y\u00f6nden itiraz imkan\u0131n\u0131n olabilece\u011fi iddias\u0131na temelden reddedilmesi gereken bir usul g\u00f6z\u00fcyle bakmamak gerekir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Di\u011fer taraftan CMK\u2019n\u0131n, 696 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname ve bunun kabul edildi\u011fi 7079 say\u0131l\u0131 kanunla de\u011fi\u015fik, 104\/2. maddesindeki <em>\u201cret kararlar\u0131na\u201d<\/em> ibaresi, <em>\u201cbu kararlara\u201d<\/em> ibaresi ile de\u011fi\u015ftirilmi\u015ftir. B\u00f6ylece tutuklu i\u00e7in h\u00e2kim veya mahkemece verilen tahliye kararlar\u0131na kar\u015f\u0131 itiraz edilebilmesi m\u00fcmk\u00fcn k\u0131l\u0131nm\u0131\u015ft\u0131r.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CMK\u2019n\u0131n 98\/1. maddesinin; <em>\u201cayr\u0131ca, tutuklama isteminin reddi karar\u0131na itiraz halinde, itiraz mercii taraf\u0131ndan da <a rel=\"noreferrer noopener\" href=\"http:\/\/Image alt attributes: Images on this page do not have alt attributes that reflect the topic of your text. CMK\u2019n\u0131n 267. ve m\u00fcteakip maddelerinde h\u00e2kim ve (<em>\u201ckanunda yaz\u0131l\u0131 kararlar\u0131na kar\u015f\u0131 olmak\u201d<\/em> kayd\u0131yla) mahkemelerin kararlar\u0131na kar\u015f\u0131 itiraz edilebilece\u011fi h\u00fckm\u00fc nazara al\u0131nd\u0131\u011f\u0131nda; Cumhuriyet savc\u0131s\u0131n\u0131n -tutuklama tedbirinin sonland\u0131r\u0131lmas\u0131na ili\u015fkin- karar\u0131na kar\u015f\u0131, -kanunda a\u00e7\u0131k bir h\u00fck\u00fcm olmad\u0131\u011f\u0131 i\u00e7in- \u201citiraz\u201d ya da ba\u015fka bir <em>\u201ckanun yolu usul\u00fc\u201d<\/em>n\u00fcn i\u015fletilmesi m\u00fcmk\u00fcn olmayacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Di\u011fer bir ifadeyle, Cumhuriyet savc\u0131s\u0131n\u0131n an\u0131lan i\u015flemine kar\u015f\u0131 itiraz\u0131 engelleyen bir yasal h\u00fck\u00fcm yoksa da, CMK\u2019daki kanun yolu us\u00fbl\u00fcn\u00fcn hakim ve kanunda belirtilen mahkeme kararlar\u0131yla s\u0131n\u0131rland\u0131r\u0131lmas\u0131, b\u00f6yle bir ba\u015fvuruya, Anayasan\u0131n 142\/1. maddesi kapsam\u0131nda g\u00f6revsizlik sebebiyle <em>\u201ckarar verilmesine yer olmad\u0131\u011f\u0131\u201d<\/em> karar\u0131 verilmesini gerektirebilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adli yarg\u0131 ilk derece ve istinaf mahkemelerinin te\u015fkilatlanmas\u0131na ili\u015fkin h\u00fck\u00fcmleri i\u00e7eren 5235 say\u0131l\u0131 Kanunun 10\/1. maddesi, sulh ceza h\u00e2kimliklerine, sadece, <em>\u201cy\u00fcr\u00fct\u00fclen soru\u015fturmalarda h\u00e2kim taraf\u0131ndan verilmesi gerekli kararlar\u0131 almak, i\u015fleri yapmak ve bunlara kar\u015f\u0131 yap\u0131lan itirazlar\u0131 incelemek\u201d <\/em>g\u00f6revini vermi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kanunun 173. maddesinde Cumhuriyet Savc\u0131s\u0131n\u0131n kovu\u015fturmaya yer olmad\u0131\u011f\u0131na dair kararlar\u0131na itiraz edilebilece\u011finin a\u00e7\u0131k\u00e7a bir istisna olarak belirtilmesi; kanunda a\u00e7\u0131k\u00e7a yaz\u0131l\u0131 olmayan hallerde Cumhuriyet savc\u0131s\u0131 i\u015flemlerine kar\u015f\u0131 kanun yollar\u0131na ba\u015fvurulamayaca\u011f\u0131 de\u011ferlendirmesini desteklemi\u015f de olmaktad\u0131r. Hukukta istisnalar\u0131n dar ve d\u00fczenlemeyle s\u0131n\u0131rl\u0131 yorumlanmas\u0131<a id=\"_ftnref56\" href=\"#_ftn56\">[56]<\/a> gere\u011fi de bu g\u00f6r\u00fc\u015f\u00fc peki\u015ftirmektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">4.3. Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na ili\u015fkin i\u015flemlere kar\u015f\u0131 mevcut yasal h\u00fck\u00fcmlere g\u00f6re yap\u0131labilecek ba\u015fvuru ve usul\u00fc \u00fczerinde de\u011ferlendirmeler<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>4.3.1. <u>Tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na kar\u015f\u0131 dilek\u00e7e hakk\u0131n\u0131n kullan\u0131lmas\u0131<\/u><\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet savc\u0131s\u0131nca tutuklama tedbirinin sona erdirilmesine ya da h\u00e2kime bu y\u00f6nde yapabilece\u011fi taleplerine kar\u015f\u0131; bunun hiyerar\u015fik y\u00f6nden denetimi i\u00e7in ba\u011fl\u0131 bulundu\u011fu Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131na bir ba\u015fvuru yap\u0131labilmesine ili\u015fkin hi\u00e7bir yasal engel yoktur. B\u00f6yle bir ba\u015fvuru, Anayasan\u0131n 74. ve 3071 say\u0131l\u0131 <em>Dilek\u00e7e Hakk\u0131n\u0131n Kullan\u0131lmas\u0131na Dair Kanun<\/em>un tan\u0131d\u0131\u011f\u0131, <em>&#8220;dilek\u00e7e hakk\u0131&#8221;<\/em>n\u0131n gere\u011fi kabul edilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ayr\u0131ca, Anayasan\u0131n 159\/9. maddesine g\u00f6re \u201c<em>H\u00e2kim ve savc\u0131lar\u0131n g\u00f6revlerini; kanun ve di\u011fer mevzuata (h\u00e2kimler i\u00e7in idar\u00ee nitelikteki genelgelere) uygun olarak yap\u0131p yapmad\u0131klar\u0131n\u0131 denetleme\u201d<\/em> yetkisine sahiptir. &nbsp;Bu sebeple, \u00f6rne\u011fin il Cumhuriyet ba\u015fsavc\u0131s\u0131n\u0131n do\u011frudan yapt\u0131\u011f\u0131 ya da denetim niteli\u011findeki i\u015flemine kar\u015f\u0131 da, Hakimler ve Savc\u0131lar Kuruluna da ba\u015fvuru yap\u0131labilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bir g\u00f6r\u00fc\u015fte dile getirildi\u011fi \u00fczere, <em>\u201c[Adalet] Bakan[\u0131]hiyerar\u015fik amir s\u0131fat\u0131yla savc\u0131ya cezaevlerinin idaresi veya herhangi bir konuda emir verebilir. Ancak dava a\u00e7\u0131lmas\u0131 veya a\u00e7\u0131lmamas\u0131 veya davan\u0131n seyrine ili\u015fkin emir veremez.\u201d<\/em><a id=\"_ftnref57\" href=\"#_ftn57\">[57]<\/a> Buna g\u00f6re, tutuklama tedbirinin kald\u0131r\u0131lmas\u0131, ancak <em>&#8220;yarg\u0131laman\u0131n seyri kapsam\u0131nda olmad\u0131\u011f\u0131&#8221;<\/em> kabul edildi\u011finde, hiyerar\u015fik denetim yap\u0131lmas\u0131 i\u00e7in Adalet Bakanl\u0131\u011f\u0131na ba\u015fvuru da m\u00fcmk\u00fcn olabilecektir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Di\u011fer bir g\u00f6r\u00fc\u015f ise yeni ceza adalet sisteminde CMK\u2019n\u0131n, Adalet Bakan\u0131n\u0131n Cumhuriyet savc\u0131s\u0131na (kamu davas\u0131 a\u00e7ma konusunda) emir verme yetkisini kald\u0131rd\u0131\u011f\u0131n\u0131 vurgulamaktad\u0131r. Bu g\u00f6r\u00fc\u015f gere\u011fince, b\u00f6ylece Cumhuriyet ba\u015fsavc\u0131s\u0131n\u0131n <em>&#8220;fonksiyonel \u00f6zerkli\u011fini&#8221;<\/em>, <em>&#8220;fonksiyonel ba\u011f\u0131ms\u0131zl\u0131\u011fa&#8221;<\/em> d\u00f6n\u00fc\u015ft\u00fcrm\u00fc\u015ft\u00fcr.<a id=\"_ftnref58\" href=\"#_ftn58\">[58]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ancak \u015furas\u0131 teredd\u00fcts\u00fczd\u00fcr ki; bu ba\u015fvuru, Cumhuriyet ba\u015fsavc\u0131s\u0131 veya vekilinin Cumhuriyet savc\u0131s\u0131n\u0131n tutuklama tedbirinin sona erdirilmesi i\u015flemini -yukar\u0131da de\u011findi\u011fi \u015fekillerde- hiyerar\u015fik olarak denetlemelerine vesile olacakt\u0131r. \u00c7\u00fcnk\u00fc Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n kendi i\u00e7indeki yap\u0131lanmas\u0131 bir hiyerar\u015fik denetime izin verdi\u011fi gibi, HSK\u2019n\u0131n bu y\u00f6nden denetimi de ayn\u0131 y\u00f6nden bir denetim olarak g\u00f6r\u00fclebilecektir.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anayasan\u0131n 36 ve 40. maddeleri ile Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinin 13. maddelerinin, t\u00fcm kamu makamlar\u0131n\u0131, kamusal i\u015flem ve faaliyetlerinde etkili eri\u015fim hakk\u0131n\u0131n gereklerine uygun davranmakla y\u00fck\u00fcml\u00fc k\u0131ld\u0131klar\u0131 burada not edilmelidir.\u00a0\u00a0 \u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u015euras\u0131 vard\u0131r ki, bu ba\u015fvurularla harekete ge\u00e7irilmek istenen, <em>&#8220;idari nitelikten \u00f6teye ge\u00e7meyen bir denetim&#8221;<\/em> olacakt\u0131r. B\u00f6ylece yap\u0131lan denetimin, hukuk devletinde ba\u011f\u0131ms\u0131z ve tarafs\u0131z bir stat\u00fcye sahip olan h\u00e2kim taraf\u0131ndan <em>&#8220;yarg\u0131sal usullere uygun yarg\u0131sal denetim&#8221;<\/em> olmad\u0131\u011f\u0131 ortaya \u00e7\u0131km\u0131\u015f olmaktad\u0131r.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>4.3.2. Tutuklama tedbirinin sona erdirilmesine ili\u015fkin Cumhuriyet savc\u0131s\u0131 i\u015flemine kar\u015f\u0131 bir yarg\u0131sal denetim olabilir mi?<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Anayasa, 125\/1. maddesinde, idari nitelikli eylem ve i\u015flemlere kar\u015f\u0131 yarg\u0131 yolunu a\u00e7m\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adli Yarg\u0131da Cumhuriyet savc\u0131s\u0131 i\u015flemleri, maddi a\u00e7\u0131dan a\u00e7\u0131k se\u00e7ik bir idari i\u015flem kabul edilmedi\u011fi gibi, \u015fekli ve organik a\u00e7\u0131dan da <em>&#8220;yarg\u0131sal i\u015flem&#8221;<\/em> addedilerek idari yarg\u0131n\u0131n g\u00f6rev alan\u0131 d\u0131\u015f\u0131nda g\u00f6r\u00fclmektedir. Yarg\u0131sal i\u015flemler kar\u015f\u0131l\u0131kl\u0131 hak uyu\u015fmazl\u0131klar\u0131n\u0131, mevcut hukuki usuller kapsam\u0131nda verilecek yarg\u0131sal nitelikteki kararlarla sona erdirmi\u015f olurlar.<a id=\"_ftnref59\" href=\"#_ftn59\">[59]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n <em>\u201cidari mekanizman\u0131n par\u00e7as\u0131\u201d<\/em><a id=\"_ftnref60\" href=\"#_ftn60\">[60]<\/a> ve Cumhuriyet savc\u0131s\u0131n\u0131n g\u00f6revlerinin de idari nitelikte oldu\u011funu<a id=\"_ftnref61\" href=\"#_ftn61\">[61]<\/a> s\u00f6ylemek iddial\u0131 bir beyand\u0131r. Dahas\u0131, Anayasan\u0131n 125\/1. maddesindeki \u201cidare\u201d deyimine, geni\u015f anlamda t\u00fcm kamusal makamlar\u0131 kapsayacak bir anlam vermek de m\u00fcmk\u00fcn olabilirse; (ki bu zorunluluk halinde yanl\u0131\u015f bir yorum olmaz) ister istemez, i\u015flemin idari i\u015flem gibi g\u00f6r\u00fclmesi m\u00fcmk\u00fcn olabilir.<a id=\"_ftnref66\" href=\"#_ftn66\"><sup>[66]<\/sup><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ne var ki b\u00f6yle bir ba\u015fvurunun, mevcut hukuki m\u00fcktesebat sebebiyle g\u00f6revsizlik sebebiyle reddedilmesi de pek muhtemel olaca\u011f\u0131ndan; konumuzla ilgili olarak yasal belirsizlikleri, ve dahas\u0131 kamu makamlar\u0131n\u0131n i\u015flemlerine kar\u015f\u0131 -h\u00e2kimlerce yap\u0131lmas\u0131 gerekli- yarg\u0131sal denetim teminat\u0131ndan mahrumiyeti giderecek bir yasal d\u00fczenlemenin gerekli oldu\u011fu ortaya \u00e7\u0131km\u0131\u015f olmaktad\u0131r.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Bir g\u00f6r\u00fc\u015fte,<a id=\"_ftnref67\" href=\"#_ftn67\">[67]<\/a> ileri s\u00fcr\u00fclen, adli yarg\u0131da tutuklama tedbirinin kald\u0131r\u0131lmas\u0131na itiraz\u0131 m\u00fcmk\u00fcn k\u0131lan yasal bir h\u00fck\u00fcm yoksa da bunu engelleyen bir h\u00fck\u00fcm de olmad\u0131\u011f\u0131na dair d\u00fc\u015f\u00fcnceye kat\u0131lmak da, mahkemelerin g\u00f6rev ve yetkilerinin kanunla d\u00fczenlenece\u011fine ili\u015fkin Anayasal ilke (m. 142\/1) gere\u011fince zodur. \u00c7\u00fcnk\u00fc, b\u00f6yle bir ba\u015fvuruya kar\u015f\u0131, muhatap al\u0131nan hakimlik ya da mahkeme, kanunda b\u00f6yle bir usul\u00fcn \u00f6ng\u00f6r\u00fclmedi\u011fi; kendilerine de b\u00f6yle bir ba\u015fvuruyu sonuca ba\u011flama yetkisi verilmedi\u011finden dolay\u0131 g\u00f6revsizlikten bahisle <em>\u201ckarar vermeye yer olmad\u0131\u011f\u0131na\u201d<\/em> karar verebilecektir.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu izahat, tutuklama tedbirinin son erdirilmesine ili\u015fkin Cumhuriyet savc\u0131s\u0131 i\u015flemine kar\u015f\u0131, bir yarg\u0131sal denetim yolunun a\u00e7\u0131k olmay\u0131\u015f\u0131, su\u00e7tan zarar g\u00f6revleri, bu karara kar\u015f\u0131 yarg\u0131sal denetimi harekete ge\u00e7irebilme teminat\u0131ndan mahrum b\u0131rakmaktad\u0131r.
