Bu do\u011frultuda grev kapsam\u0131ndaki hareketler,\u00a0<a href=\"http:\/\/www.hukukiyaklasim.com\/makaleler\/grevin-maddi-unsuru-olarak-isi-birakmak-kavrami-kapsami\/\">Grevin Maddi Unsuru Olarak \u0130\u015fi B\u0131rakma Kavram\u0131 Ve Kapsam\u0131<\/a> \u00a0\u00e7al\u0131\u015fmam\u0131zda de\u011findi\u011fimiz maddi unsurunu te\u015fkil ederken, i\u015f b\u0131rakman\u0131n grev amac\u0131yla yap\u0131lmas\u0131 da grevin manevi unsurunu te\u015fkil etmektedir.<!--more--><\/p>\n<h3>Grev Kapsam\u0131nda \u0130\u015fi B\u0131rakma Amac\u0131 ve Kapsam\u0131<\/h3>\n<p>Yukar\u0131da belirtti\u011fimiz i\u015fi b\u0131rakma grev i\u00e7in tek ba\u015f\u0131na yeterli bir unsur de\u011fildir. Ayr\u0131ca, topluca i\u015fi b\u0131rakmak suretiyle, o i\u015fyerinde faaliyeti durdurma veya i\u015fin niteli\u011fine g\u00f6re \u00f6nemli \u00f6l\u00e7\u00fcde aksatma amac\u0131n\u0131n da izlenmi\u015f olmas\u0131 gerekir. \u0130\u015f\u00e7ilerin i\u015fi durdurmalar\u0131n\u0131n veya \u00f6nemli \u00f6l\u00e7\u00fcde aksatmalar\u0131n\u0131n sebebi, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n lehe de\u011fi\u015ftirilmesi iste\u011fi veya kanun tasar\u0131lar\u0131n\u0131 ya da i\u015fveren tasarruflar\u0131n\u0131 protesto etme yahut ba\u015fka bir grevi destekleme olabilir. ST\u0130SK madde 58\/2 ye g\u00f6re <em>grev, toplu i\u015f s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 halinde i\u015f\u00e7ilerin ekonomik ve sosyal durumlar\u0131 ile \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131 korumak veya geli\u015ftirmek amac\u0131yla yap\u0131labilir.<\/em><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Bu madde ile anayasan\u0131n 53. maddesinde ki toplu i\u015f s\u00f6zle\u015fmesi hakk\u0131n\u0131n amac\u0131 ve 54. maddesindeki grev hakk\u0131n\u0131n toplu i\u015f s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda \u00e7\u0131kan uyu\u015fmazl\u0131\u011fa ba\u011fl\u0131 olarak kullan\u0131labilece\u011fine ili\u015fkin ilkeler vurgulanmak istenmi\u015ftir. Ayn\u0131 \u015fekilde anayasan\u0131n 54\/7. maddesindeki,<\/p>\n<h4><em>\u201csiyasi ama\u00e7l\u0131 grev ve lokavt, dayan\u0131\u015fma grev ve lokavt\u0131, genel grev ve lokavt, i\u015fyeri i\u015fgali, i\u015fi yava\u015flatma, verimi d\u00fc\u015f\u00fcrme ve di\u011fer direni\u015fler yap\u0131lamaz\u201d<\/em><\/h4>\n<p>H\u00fckm\u00fc ST\u0130SK\u2019ya da girmi\u015ftir. \u0130\u015fyeri i\u015fgali, i\u015fi yava\u015flatma, verimi d\u00fc\u015f\u00fcrme ve di\u011fer direni\u015flerin kanunda belirtilmemi\u015f olmas\u0131 hukuka uygun hale getirmez. Belirtilen eylem ve direni\u015fleri yapma hakk\u0131 veren veya hukuka uygun hale getiren hukuki bir dayanak da yoktur. \u0130\u015fyeri i\u015fgali, i\u015fi yava\u015flatma, verimi d\u00fc\u015f\u00fcrme ve di\u011fer direni\u015fler i\u015fverenin te\u015febb\u00fcs h\u00fcrriyetini s\u0131n\u0131rlayaca\u011f\u0131 i\u00e7in kanunda a\u00e7\u0131k\u00e7a izin verilmedi\u011fi s\u00fcrece yasak olarak kalacakt\u0131r ve ayn\u0131 zamanda i\u015f\u00e7ilerin i\u015fverene olan i\u015f g\u00f6rme borcuna ayk\u0131r\u0131l\u0131k olu\u015fturacakt\u0131r. Ama\u00e7 unsurunun i\u00e7inde, i\u015f\u00e7ilerin i\u015fyerindeki i\u015flerine ba\u011fl\u0131 kalmalar\u0131 esas\u0131 da yer almaktad\u0131r.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> \u0130\u015fyerinin devaml\u0131 olarak terk edilmesi halinde \u00e7al\u0131\u015fma ko\u015fullar\u0131nda de\u011fi\u015fiklik yapmak amac\u0131 bulunamayaca\u011f\u0131na g\u00f6re, i\u015f\u00e7ilerin i\u015fyerine ba\u011fl\u0131 kalarak \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 d\u00fczeltmek d\u00fc\u015f\u00fcncesinde olmalar\u0131 ama\u00e7 unsurunun i\u00e7inde aran\u0131lmas\u0131 gerekli bir \u015fart olarak kabul edilmelidir.<\/p>\n<p>Her toplu i\u015fi b\u0131rakma grev de\u011fildir; grevde, spesifik olarak topluca \u00e7al\u0131\u015fmamak suretiyle i\u015fyerinde faaliyetin durdurulmas\u0131 veya \u00f6nemli \u00f6l\u00e7\u00fcde aksat\u0131lmas\u0131 ama\u00e7lan\u0131r. \u0130\u015fyerinde faaliyetin durmas\u0131 veya \u00f6nemli \u00f6l\u00e7\u00fcde aksamas\u0131, <em>\u201cgrev karar\u0131nda g\u00fcd\u00fclen hedef\u201dtir<\/em>. Bu hedef fiilen ger\u00e7ekle\u015fmeyebilir.<\/p>\n<p>Dolay\u0131s\u0131yla greve kat\u0131lan i\u015f\u00e7ilerin say\u0131s\u0131 \u00f6nemli de\u011fildir. Say\u0131n\u0131n b\u00f6yle bir neticenin do\u011fmas\u0131na yeterli olmamas\u0131 da grevin olu\u015fmas\u0131n\u0131 engellemez. Ba\u015fka t\u00fcrl\u00fc grev hakk\u0131 \u00f6nemli \u00f6l\u00e7\u00fcde s\u0131n\u0131rlanm\u0131\u015f olacakt\u0131r. Nitekim uygulamada kat\u0131lanlar\u0131n say\u0131s\u0131 grev s\u00fcrerken artabilmektedir.<\/p>\n<h3>Ba\u015fka ama\u00e7larla i\u015fi b\u0131rakman\u0131n Grev Tan\u0131m\u0131na Etkisi<\/h3>\n<h3><strong><em>1-) \u0130\u015fin Grev Ama\u00e7lanmadan Us\u00fbls\u00fcz B\u0131rak\u0131lmas\u0131<\/em><\/strong><\/h3>\n<p>\u0130\u015fi durdurma veya aksatma ama\u00e7lar\u0131 d\u0131\u015f\u0131nda ba\u015fka nedenlerle i\u015fin b\u0131rak\u0131lmas\u0131 grevin yasal tan\u0131m\u0131na uymamaktad\u0131r. \u00d6rne\u011fin bir nikah veya ma\u00e7a topluca gidilmesi ya da protesto y\u00fcr\u00fcy\u00fc\u015f\u00fcne veya mitinge kat\u0131lmak amac\u0131yla i\u015f\u00e7ilerin topluca i\u015fyerinden ayr\u0131lmas\u0131, grev de\u011fildir. Bu yakla\u015f\u0131m yasa d\u0131\u015f\u0131 greve ba\u011fl\u0131 yapt\u0131r\u0131mlar\u0131n uygulanmas\u0131n\u0131 da \u00f6nleyece\u011finden i\u015f\u00e7inin yarar\u0131nad\u0131r. Bununla birlikte izin almadan i\u015fin b\u0131rak\u0131lmas\u0131, duruma g\u00f6re disiplinsizlik ve s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011finden, baz\u0131 durumlarda i\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedenle feshine yol a\u00e7abilir. Bir olayda, \u00dcniversiteye ait hastanede \u00e7al\u0131\u015fan bir i\u015f\u00e7i kesimi, toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri devam ederken \u00e7e\u015fitli eylemlerde bulunmu\u015f (sakal b\u0131rakma, yemek saatinde birlikte ayr\u0131lma, alk\u0131\u015fl\u0131 protesto, sendika odas\u0131n\u0131n bo\u015falt\u0131lmas\u0131) ve bir a\u00e7\u0131klama yap\u0131laca\u011f\u0131 durumu \u00fczerine de g\u00f6rev yerinden k\u0131sa s\u00fcreli ayr\u0131lan 117 i\u015f\u00e7i hastane \u00f6n\u00fcnde toplanm\u0131\u015ft\u0131r. Yarg\u0131tay, tutanaklar ve tan\u0131k beyanlar\u0131 aras\u0131nda ki \u00e7eli\u015fkileri de dikkate alarak, s\u00f6z konusu hareketin i\u015fi b\u0131rakma m\u0131 yoksa s\u0131rf yap\u0131lacak bir konu\u015fmay\u0131 dinleme ama\u00e7l\u0131 m\u0131 oldu\u011funun a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 ve ger\u00e7ekten g\u00f6revli olanlar\u0131n g\u00f6rev yerini izinsiz terk ettiklerinin somut kan\u0131tlarla saptanmas\u0131 gerekti\u011fini belirtmektedir.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<h3>2-) \u0130\u015fin ge\u00e7ici ya da Grev Say\u0131lmayacak Nedenle B\u0131rak\u0131lmas\u0131<\/h3>\n<p>\u0130\u015f s\u00f6zle\u015fmelerinin i\u015f\u00e7iler taraf\u0131ndan topluca feshi gibi <em>bir ama\u00e7, d\u00fc\u015f\u00fcnce veya hede<\/em>f, grevden tamamen farkl\u0131 de\u011ferlendirilmelidir. Zira grevde i\u015f ge\u00e7ici olarak b\u0131rak\u0131l\u0131r ve yeni bir toplu i\u015f s\u00f6zle\u015fmesi olmad\u0131\u011f\u0131ndan, <em>mevcut olan evvelki i\u015f s\u00f6zle\u015fmesinden do\u011fan<\/em> hak ve bor\u00e7lar ask\u0131da kal\u0131r. Grevin tan\u0131m\u0131nda hareketin ge\u00e7ici niteli\u011finin ayr\u0131ca belirtilmemi\u015f olmas\u0131, her halde b\u00f6yle bir a\u00e7\u0131klaman\u0131n gereksiz g\u00f6r\u00fclmesinden \u00f6t\u00fcr\u00fcd\u00fcr. Nitekim greve ili\u015fkin esaslar, \u00f6zellikle de hak ve bor\u00e7lar\u0131n ask\u0131da kalaca\u011f\u0131na dair yasal h\u00fck\u00fcmler, grev de sadece ge\u00e7ici bir i\u015fi b\u0131rakman\u0131n s\u00f6z konusu oldu\u011funu g\u00f6stermektedir.<\/p>\n<p>Yukar\u0131da belirtti\u011fimiz \u00fczere, i\u015fyerinde i\u015fi durdurma veya \u00f6nemli \u00f6l\u00e7\u00fcde aksatma amac\u0131n\u0131n d\u0131\u015f\u0131nda hareket etme halinde ise, grevden s\u00f6z edilemez. \u00d6rnek olarak, i\u015f\u00e7ilerin aralar\u0131nda anla\u015farak hi\u00e7bir anla\u015fma olmaks\u0131z\u0131n veya anla\u015farak bir ma\u00e7a veya mitinge ya da geziye topluca gitmeleri, grev de\u011fildir. \u00c7\u00fcnk\u00fc bu hareketleri sonucunda i\u015f dursa veya \u00f6nemli \u00f6l\u00e7\u00fcde aksam\u0131\u015f olsa dahi, onlar\u0131n ama\u00e7lar\u0131 bu de\u011fildir. Ancak i\u015f\u00e7ilerin aralar\u0131nda anla\u015farak i\u015fi b\u0131rakmalar\u0131 sonucu i\u015fyerinde i\u015f durmu\u015f veya \u00f6nemli \u00f6l\u00e7\u00fcde aksam\u0131\u015fsa, bunun hangi ama\u00e7la yap\u0131ld\u0131\u011f\u0131n\u0131 kan\u0131tlamak, genellikle son derece g\u00fc\u00e7t\u00fcr.<\/p>\n<h3><em>3-) \u0130\u015fi b\u0131rakma \u201camac\u0131yla\u201d anla\u015fma veya bir kurulu\u015fun \u201cbu ama\u00e7l\u0131\u201d karar\u0131na uyma<\/em><\/h3>\n<p>Grevin di\u011fer bir unsuru ise, i\u015f\u00e7ilerin aralar\u0131nda anla\u015fmas\u0131 veya bir kurulu\u015fun ayn\u0131 ama\u00e7la topluca \u00e7al\u0131\u015fmamalar\u0131 i\u00e7in verdi\u011fi bir karara uymas\u0131d\u0131r. Kanunun anlat\u0131m\u0131na g\u00f6re, i\u015f\u00e7i sendikas\u0131n\u0131n karar\u0131 faaliyeti durdurmay\u0131 veya \u00f6nemli \u00f6l\u00e7\u00fcde azaltmay\u0131 hedef almal\u0131d\u0131r. Bunun ger\u00e7ekle\u015fip ger\u00e7ekle\u015ftirilmemesi ise grevin uygulanmas\u0131 ile ilgili olup karar unsuru ile ilgili de\u011fildir. Buna g\u00f6re, grevci i\u015f\u00e7ilerin ayn\u0131 amac\u0131 izlemeleri yeterli olmay\u0131p, ayr\u0131ca o amac\u0131 ortakla\u015fa izlemeleri de gerekir. Ancak ortak hareketin a\u00e7\u0131k\u00e7a veya \u00f6rt\u00fcl\u00fc olarak kararla\u015ft\u0131r\u0131lmas\u0131 fark etmez.<\/p>\n<p>\u0130\u015f\u00e7ilerin aralar\u0131nda anla\u015fmas\u0131 i\u00e7in, en az ka\u00e7 ki\u015finin karara kat\u0131lm\u0131\u015f olmas\u0131 gerekti\u011fi konusu ST\u0130SK madde 58 de yer almam\u0131\u015ft\u0131r. Ancak karara kat\u0131lacak i\u015f\u00e7ilerin say\u0131s\u0131n\u0131n, o i\u015fyerinde i\u015fi durduracak veya \u00f6nemli \u00f6l\u00e7\u00fcde aksatacak miktarda olmas\u0131 gerekmez. Aksi halde, grev hakk\u0131, \u00f6nemli \u00f6l\u00e7\u00fcde s\u0131n\u0131rlanm\u0131\u015f olur. \u00c7\u00fcnk\u00fc greve kat\u0131lanlar\u0131n say\u0131s\u0131, grev s\u00fcrerken artabilir. \u015euras\u0131 \u00e7ok \u00f6nemlidir ki bize g\u00f6re;<\/p>\n<p>G<em>revin hukuka uygunlu\u011fu ile ba\u015far\u0131s\u0131, farkl\u0131 \u015feylerdir.<\/em><\/p>\n<p>B\u00f6ylece i\u015fi b\u0131rakma i\u00e7in anla\u015fma ve hatta bu karara uymada asgari i\u015f\u00e7i say\u0131s\u0131 aranmamaktad\u0131r.<\/p>\n<h4>3a\u2013) Toplu veya kurulu\u015f karar\u0131yla hareket etme amac\u0131<\/h4>\n<p>Grevin karakteristik \u00f6zelli\u011fi, kollektif olmas\u0131d\u0131r. Zaten kolektif nitelik \u00f6n planda oldu\u011fu i\u00e7indir ki, \u00fccretini zaman\u0131nda alamayan i\u015f\u00e7ilerin i\u015fi b\u0131rakmalar\u0131 hakk\u0131nda \u00f6\u011freti ile yarg\u0131 kararlar\u0131ndaki s\u0131n\u0131rlay\u0131c\u0131 yakla\u015f\u0131m benimsenmi\u015fti. Yasan\u0131n anlat\u0131m\u0131na bak\u0131l\u0131rsa (bize g\u00f6re ama\u00e7 olarak) bizzat i\u015fi b\u0131rakma de\u011fil, karar\u0131n kolektif nitelik ta\u015f\u0131mas\u0131 yeterlidir.<\/p>\n<p>Bir grevden s\u00f6z edebilmek i\u00e7in, i\u015f\u00e7iler aralar\u0131nda anla\u015farak veya te\u015fekk\u00fcl karar\u0131na uyarak i\u015fi b\u0131rakmal\u0131d\u0131r. Karar i\u015f\u00e7iler aras\u0131nda al\u0131nm\u0131\u015fsa, bu karara kat\u0131lanlar bak\u0131m\u0131ndan bir asgari say\u0131 belli bir oran aranmaz. Grev karar\u0131 genellikle bir i\u015f\u00e7i te\u015fekk\u00fcl\u00fc taraf\u0131ndan al\u0131n\u0131r. Grevin olu\u015fabilmesi a\u00e7\u0131s\u0131ndan i\u015f\u00e7i te\u015fekk\u00fclleri aras\u0131nda bir ayr\u0131m yap\u0131lmam\u0131\u015ft\u0131r. Ancak grevin yasal olabilmesi i\u00e7in \u00f6rne\u011fin yetkili sendika taraf\u0131ndan kararla\u015ft\u0131r\u0131lmas\u0131 gerekir.<\/p>\n<p>Uygulama da greve karar veren sendikaya \u00fcye olmayan i\u015f\u00e7ilerin de dayan\u0131\u015fma duygusuyla greve kat\u0131ld\u0131klar\u0131 g\u00f6r\u00fclmektedir. Bu durumun Anayasan\u0131n 54. maddesinde yer alan ve yukar\u0131da de\u011finilen dayan\u0131\u015fma grevini yasaklayan h\u00fckm\u00fcne ayk\u0131r\u0131l\u0131k te\u015fkil etmeyecek <em>\u201cama\u00e7 ve i\u00e7erikte\u201d<\/em> olmas\u0131 halinde yasal addedilmesi m\u00fcmk\u00fcn olabilir.<\/p>\n<h4>3b\u2013) Bireysel kararla i\u015fi b\u0131rakma<\/h4>\n<p>Bireysel bir kararla tek i\u015f\u00e7inin protesto amac\u0131yla i\u015fi b\u0131rakmas\u0131 grev say\u0131lamaz ve gerekti\u011finde disiplin cezas\u0131na, hatta i\u015f s\u00f6zle\u015fmesinin feshine yol a\u00e7abilir. Buna kar\u015f\u0131l\u0131k, \u00f6zde kolektif nitelik ta\u015f\u0131d\u0131\u011f\u0131 i\u00e7in, <em>al\u0131nan bir sendika karar\u0131 \u00fczerine i\u015fyerinde tek i\u015f\u00e7inin i\u015fi b\u0131rakmas\u0131<\/em> Tun\u00e7oma\u011f\u2019a g\u00f6re grev te\u015fkil etmelidir. Konuyla ilgili Yarg\u0131tay Tek i\u015f\u00e7i durumundaki bir apartman kap\u0131c\u0131s\u0131 i\u00e7in al\u0131nan grev karar\u0131n\u0131n yasal olmad\u0131\u011f\u0131n\u0131n tespitine karar vermi\u015ftir.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>Grev i\u015f\u00e7ilerin, bir kurulu\u015fun karar\u0131na uyarak i\u015fi b\u0131rakmalar\u0131d\u0131r. Bu karar\u0131 alacak kurulu\u015f, kural olarak i\u015f\u00e7i sendikas\u0131d\u0131r. Nitekim i\u015f\u00e7i sendikas\u0131 grev karar\u0131 al\u0131nca, \u00fcyeleri \u00fcyelik y\u00fck\u00fcmleri nedeniyle ve \u00fcye olmayan i\u015f\u00e7iler de dayan\u0131\u015fma duygusuyla bu karara uyarlar. \u0130\u015f\u00e7i sendikas\u0131n\u0131n toplu i\u015f s\u00f6zle\u015fmesi yetkisinin bulunmas\u0131, yani \u00e7o\u011funlukla sahip olmas\u0131 gerekmez.
